The New Justice For All

We have had ups and downs in this blog and Montanans For Justice feels that now would be a good time to make a clean start. With over 1000 comments between 6 posts, there has been plenty of attention. Maybe it would help to have only one post…? Let’s try this for awhile. Is The Confession Admissible?

Colin Miller, a professor at the John Marshall Law School and editor of the Evidence Prof Blog http://lawprofessors.typepad.com/evidenceprof/, has done some research into the Barry Beach case and determined that the transcript of Beach’s alleged confession to Louisiana authorities possibly should have been excluded at his trial and might be excluded should he be granted a new trial.  Miller argues that there is a reasonable argument that the tapes of Beach’s confession were lost in bad faith, precluding the introduction of the transcript into evidence.  You can find all of Miller’s thoughts on the matter at the Evidence Prof Blog:

This is exactly why we have it there: for those of you who could not for personal and protective reasons come forward in any other manner. We knew that there are some true Montanans out there with information about this case who would want justice for everyone involved. Dateline NBC has investigated this case thouroughly and will not be revealing any evidence against Barry Beach…because there is none!

Coerced Confession vs. Real Confessions

Barry Beach gave a coerced confession to detectives in Louisiana that ultimately led to his conviction. Many have come forward over the years since that conviction stating that they have overheard or been the recipient of confessions from several people in the Poplar area. Who has heard anything and what was said? How can this help Barry’s plight?

A new trial…a new life

Barry Beach is currently serving a prison term of 100 years without the possibility of parole. Our judicial system demands a conviction beyond a reasonable doubt. Would you agree that there is reasonable doubt in this case? Is there any physical evidence pointing at Barry Beach? What if the coerced confession that was obtained from Barry in Louisiana is taken out of the picture? Could you convict Barry? The tragic event in 1979 has already ended one life. Could a new trial save the remaining portion of another innocent life?

A system of justice or injustice?

We are Americans and we love our country. Most of us are Montanans and proud of it. Knowing that our judicial system is imperfect is not something we are pleased with, but it is something that is very real. The government we elect does not like to admit they can be wrong and has shown that they will go to great lengths to try and convince every citizen that they are infallible. As it pertains to Barry Beach, how do we get our elected officials to admit that they are human and that errors can and do exist? At what point does their awareness of an injustice and lack of action cause a moral dilemma in the job they were elected to do?

Let us examine the evidence

There is so much evidence in this case that it would seem that a positive identification of the murderer would be an easy task. Yet, none of the physical evidence in this case points toward the man incarcerated for the crime. How do we (as a system of justice) find the person(s) whom the physical evidence does reveal? What evidence can be used?
