    The last blog has one problem— One little correction on that blog entry. Melnikoff DID NOT testify at Barry’s trial. He was in Glasgow prepared to go on the stand. Racicot decided not to use his testimony when he learned that the evidence chain had been compromised. Although Melnikoff did not testify, Racicot, in his opening statement, said that he would introduce evidence that a pubic hair belonging to Beach was recovered from Kim’s sweater. This “fact” which he repeated in his closing argrument was even more damaging and prejudicial than the proposed testimony of Melnikoff.

    Since we haven’t heard from the Montana Supreme Court about
    Barry’s case; thought I’d post the peer report on Arnold
    Melinkoff; and the fact it’s highly suggest an outside
    audit of ALL Melinkoff’s cases be done. Not just what 4
    that McGrath ordered? Has Steve Bullock ordered this audit?
    Does anyone know?

    Makes one wonder why, The Chief Justice of the Montana
    Supreme Court, while still the Attorney General felt it
    unimportant to have these cases Melinkoff testified in
    court using his famous on-liner, “the hair has similar
    characteristics to that of the defendant.” Melinkoff
    testified at Barry’s trial too using the same
    line; McGrath knows very well Barry Beach is innocent!

    Is that the hold up? It’s been almost a year now isn’t it
    about time McGrath? What are you afraid of? The truth?
    The EXPERTS all are saying the same thing!

    PEER REVIEW REPORT: MONTANA V. JIMMY RAY BROMGARD

    WE, the undersigned, have reviewed the direct examination
    transcript of the testimony of Arnold Melnikoff, hair
    examiner and Laboratory Manager of the Montana Laboratory
    of Criminalistics, in the case of State v. Jimmy Bromgard.

    We have focused our attention on the questions and answers
    below, in which Mr. Melnikoff discussed the probabilities
    of erroneous associations in the microscopical comparison
    of human hair.

    On page 236 of the transcript are the following questions
    and answers:

    Q. How common is it for two individuals to have head hair
    which is microscopically indistinguishable?

    A. Well the best way that I know to answer that question
    is to relate to my own case work experience, and I have
    done over 700 cases involving head hair and have only had
    five or six cases where I could not distinguish the head
    hair between two individuals.

    Q. What is your experience in the same regard with pubic
    hair?

    A. Well I have probably examined less cases because not
    all the cases involving hair involve pubic hair, but I
    would guess it’s probably close to 500 cases, most of the
    time it does, and I have had the experience where only
    three times pubic hair standards from two individuals
    submitted in the case could not be distinguished.

    On pages 237 and 238 of the transcript are the following
    question and answer:

    Q. So each one would be one in a hundred, what would the
    two together be. In other words if the pubic hair and head
    hair are both matching up, what are the odds of that being
    a mistake?

    A. Well there are actually two mutually exclusive events
    because they come from different areas of the body, and
    their characteristics are not necessarily the same. So if
    you find both head and pubic hair there you have one
    chance in a hundred for the head hair matching a particular
    individual and one chance in a hundred for the pubic hair.
    If you find both it’s a multiplying effect, it would be one
    chance in 10,000, it’s the same as two dice, if you throw
    one dice with a one, one chance out of six; if you throw
    another dice with a one, it’s one chance out of six, you
    multiply the odds together. You do the same in this case,
    so it’s one times one hundred, times one, times one
    hundred, and you get one in 10,000.

    The following exchange is found on page 238 of the
    transcript:

    Q. Consequently, so that I understand it correctly and the
    jury understands it correctly, is it your opinion that
    there is less than one in ten thousand chance that this
    was not actually Jimmy Bromgard’s hair?

    A. Yes.

    We have reached the following conclusions:

    1. The witness’s testimony on pages 237-238 contains
    egregious misstatements not only of the science of
    forensic hair examinations but also of genetics and
    statistics. These statements reveal a fundamental lack of
    understanding of what can be said about human hair
    comparisons and about the difference between casework and
    empirical research. His testimony is completely contrary
    to generally accepted scientific principles.

    2. The witness’s use of probabilities is contrary to the
    fact that there is not - and never was - a well established
    probability theory for hair comparison.

    3. The witness’s testimony is contrary to the consensus
    practice B as it existed in 1987 B for forensic hair
    comparisons and testimony regarding such comparisons.

    4. In the Bromgard case, Mr. Melnikoff matched both head
    and pubic hairs of the accused to questioned hairs from
    the crime scene. Based on the postconviction DNA testing
    carried out in this case, we now know that none of the
    questioned hairs could have come from Mr. Bromgard. While
    an experienced hair examiner might erroneously associate a
    single head or pubic hair, it is highly unlikely that a
    competent hair examiner would incorrectly associate both
    head and pubic hairs.

    5. If this witness has evaluated hair in over 700 cases as
    he claims in his testimony, then it is reasonable to assume
    that he has made many other misattributions.

    Good laboratory practice and all quality assurance/quality
    control programs require an investigation in a case such as
    this. However, the fact that the examiner was also the
    Laboratory Manager for the Montana Laboratory of
    Criminalistics would suggest that an internal investigation
    by that laboratory would be inappropriate. We understand
    that the laboratory is ultimately under the control of the
    Montana Attorney General.

    ACCORDINGLY, we urge the Montana Attorney General to create
    an audit committee comprised of experts from outside the
    state laboratory. The committee should be authorized to
    examine the following:

    1. Transcripts of the testimony of Arnold Melnikoff in
    every case in which he testified.

    2. The evidential hairs in this case. These should be
    re-examined to determine if the witness’s conclusions that
    the head hairs and pubic hairs exhibited the same
    microscopic characteristics as the known head and pubic
    hairs of Mr. Bromgard are correct.

    3. Evidential hairs in all other hair cases in which Mr.
    Melnikoff conducted the examinations. This re-examination
    should be undertaken if one, or both, of the questioned
    hairs in the Bromgard case is found to be microscopically
    dissimilar to known hairs from Mr. Bromgard.

    4. The testimony of anyone who was trained by Mr. Melnikoff.
    The capabilities of anyone trained by Mr. Melnikoff as a
    hair examiner must be regarded at this point as highly
    suspect.

    At the conclusion of the audit, the committee should submit
    a written report detailing its findings. We are confident
    that you share the importance of this investigation and
    audit since the human consequences of a forensic
    scientist=s misstatements can be extraordinary.

    knows he’s got a suspected co-consiperator to Kim Nees
    murder working for him?

    By the way her statement to the AG read I can’t believe
    she’s a manager over anything especially a college
    where she’s got any type of influence with young adults!

    I came on to see if there is any news regarding the Supreme Court. This is not the place to try to convince anyone who knows Barry Beach better. There are so many people across the country who know Barry Beach quite well. Many are visitors or have visted Barry at one time or another. Barry has many very close friends, whether female or not, is beside the point. These are people who believe in his innocence just like you and me.

    Sometimes you need to step back and ask yourself if your own jealousy is really helping or hurting Barry. he needs your help and he needs your support and your prayers. he certainly does not need this kind of garbage!

    Instead of pushing people away why not try to encourage others to join our fight for justice. Aren’t we all after the same thing here? JUSTICE FOR KIM and FREE BARRY BEACH

    You seem to have enough energy and time to comment on this blog - have you writen your letter of support or letters to the editors? Have you written to Barry to offer words of encouragement? Have you sent in a donation to CM or MFJ? Need a new t-shirt? Need a DVD to give to the neighbors? I’m sure MFJ can help you out!

    Have you gone over the transcripts and statements? Have you read all the evidence on this web site? Have you encouraged your family, friends and neighbors to join in this fight for justice?

    let’s turn this around - who do YOU think that palm print belongs to and why?

    How many people has Sissy Atkinson admitted to that she killed Kim Nees? Name them!

    I quit blogging months ago, mainly for reasons like the above comments where girls want to compete with “what they know.” These blogs started to show our support and bounce ideas off one another. We were suppose to comment about the story, transcripts, and evidence. The ones that really want to help are pushed away out of jealously. I don’t know Barry and won’t pretend to. I have no intention of ever wanting to know him. I also don’t want to know Sharon, (AKA SHADOW OF DOUBT?) Darlene, Susan, or the girl from Montana that was so involved. I stuck by this man because it seemed that he wasn’t the killer and he wasn’t given a fair shake, not because I wanted a relationship with him. Maybe bloggers will come back someday when the cat fights have stopped. Until then, I still stand behind Barry’s innocence.

    OUCH!! Did a nerve get hit? I have also visited many prisoners and that’s not what they are saying. Maybe Barry just wanted to be Mr. tough guy when he got there so he could survive. He is not the guy he wants everyone to believe he is. Do you also believe he was stabbed numerous times like his mother said in an article?
    Must be a reason why the Supreme Court hasn’t ruled

    I have known and visited Barry as well as many other prisoners in Deer Lodge for over five years and #2180 does not know what he/she speaks. The above statement is not true. Barry has never told anyone that he “really did kill Kim”.

    #2174 - Must be on the Parole Board huh? Perhaps hit a guilty nerve? You know I haven’t been on here and commented in a long time, but I just can’t help myself. First of all I don’t see where the Parole Board numbers were posted. Like I said I haven’t been on in a while. Maybe I missed it. Second that is public knowledge and ANYONE can get those numbers. Third, do you really think that the Board of Pardon and Parole are doing thier job when on national television they appeared to be sleeping? These people are dictating folks lives and they can’t stay awake long enough to get thru a hearing? Fourth - “agree with them” - for the love of God half the damn country didn’t agree with them in regards to Barry Beach’s case!

    It is absolutely mind blowing after watching Dateline SEVERAL times that anyone would be scared of Sissy. Perhaps years ago she was something to fear but come on you can’t all be seriously afraid of her today. Most of those involved who were there and witnessed this horrific crime don’t even live near that frail, crack head Sissy. What in the world are you afraid of? Don’t most of you have children and grandchildren. Would you want this to happen to you or your family?> Years go by and still no justice! Barry Beach wasn’t involved, many of you have told others he is serving someone elses time. If the shoe was on the other foot would you be as tight lipped about it all? For those of you there and who did not participate, but know something, isn’t it time to get this off your chest?

    The killer confesses, so he’s obviously guilty.

    Except in the dozens of instances where it is a false, coerced
    confession.

    We have one of the most notorious examples in the land here in
    Connecticut in the case of Richard Lapointe, a mentally disabled man who
    made three contradictory confessions to police during a 10-hour
    interrogation after his wife’s grandmother was found raped and killed in
    1989. He remains in jail.

    Aging, dogged supporters of Lapointe, who was convicted in 1992, are
    optimistic that they can win a new trial in the case. This spring, an
    appellate court ordered a new trial on the question of whether
    Lapointe’s lawyers botched their job and the entire case should be
    retried. Lapointe’s friends are ecstatic that the case will also go
    before a different judge, very likely this fall.

    “The question is whether there is any veracity to this confession,”
    Lapointe’s lawyer, Paul Casteleiro, told me the other day.

    If you think we’re hearing more about confessions-gone-wrong and
    exoneration of long-incarcerated inmates, we are.

    A new book, “True Stories of False Confessions,” will be released next
    week. It covers dozens of cases - including my colleague Tom Condon’s
    examination of the Lapointe conviction - of questionable confessions and
    wrongful convictions.

    “False confessions are really one of the most perplexing, tragic and
    counterintuitive phenomena you can imagine,” said Rob Warden, co-editor
    of the book and executive director of the Center on Wrongful Convictions
    at Northwestern University, which has helped win freedom for 35 people
    over the past decade.

    “People can’t imagine that they would ever confess to crimes they don’t
    commit.”

    In one of his three confessions, Lapointe - a man with limited mental
    capacity who had no lawyer present - said that “if the evidence shows I
    was there and that I killed her, then I killed her. But I don’t remember
    being there.”

    Warden said Lapointe “fits right into the brainwashing phenomenon. They
    persuaded him that he must have done it.”

    The new book uses reporting of journalists around the country, detailing
    the stories of 39 people and 49 confessions gone awry.

    There is Michael Crowe, a California teenager who, after a lengthy
    interrogation, confessed to killing his sister, even writing a letter to
    her stating that “I’m so sorry that I can’t even remember what I did to
    you … the fact that I can’t remember is a blessing from god.”

    DNA tests later revealed that a mentally disabled drifter was
    responsible for the killing.

    “If you think Richard Lapointe is bad, we have one where it is clear
    that one young man confessed to the murder, but he was in police custody
    at the time it occurred,” Warden said. “These stories are really
    amazing, and we hope it has an impact in explaining to people why people
    falsely confess.”

    “When you read them together it shows a distinct pattern and the need to
    reform interrogation practices. We should require the police to record
    the interrogation process electronically. We think interrogation ought
    to be limited to six hours. Police ought to be forbidden to lie to
    suspects about certain facts.”

    Lapointe’s lawyers hope their case illustrates how interrogation methods
    can lead to disastrous, and false, conclusions - and why, at the very
    least, “confessions” should be videotaped.

    “This is a prototype case,” Casteleiro said. “You’ve got a guy who is
    less sophisticated than the police, who is trusting of the police and
    wanting to please them.”

    Killers do confess. So, apparently, do others.

    wow Sharon, way to go… Mike Mc Grath DOES not HAVE to recuise himself, he was NOT one of the lawyers at Barry’s origional trial, he has NEVER heard Barry’s case before his court..

    Could it be as reported after Bromgard was released there are over 200 plus individuals requesting forensic (DNA) evidence be re-tested because Melinkoff was found incompetent by a court of law and his peers? BUT McGrath only approved 9? Wouldn’t this be conflict of interest because Melinkoff helped convict McGrath’s cases not to mention Racicot’s? How many innocent victims besides Barry sit in prison still today because of this?

    This is not true either,,, Judge Carla Grey wanted those who Melnikoff had “TESTIFIED” to and who was part of the trials… not all 200,,, get a grip

    Could it be because Barry’s attorney’s requested the evidence in his own case for analysis; but the Montana Crime Lab could not locate the evidence while McGrath was in office as the Montana Attorney General? Who did McGrath hold accountable? Why didn’t McGrath insist as offered an independant auditor be allowed access to the crime lab?

    Could it be because there is to this day 11 fingerprints still UNIDENTIFIED including the bloody palm print from Barry’s case BUT Barry’s prints were conclusively cleared by the FBI?

    Could it be The State of Montana has FAILED TO PROVE BARRY BEACH killed Kim Nees and took the easy way out instead of finding and incarcerating the GUILTY?

    McGrath’s statement on the Montana Surpreme Court web-site is redicilious; as quoted:

    My question is where is Barry’s equal access to justice; the public trust; and confidence in the MONTANA JUDICIAL SYSTEM? THERE IS NONE!!

    3-1-803. Disqualification of judges — all courts.
    DISQUALIFICATION OF JUDGES
    This section shall, in its application, apply to all courts listed in section 3-1-101 except a court of impeachment in the state senate.
    Any justice, judge, justice of the peace, municipal court judge or city court judge must not sit or act in any action or proceeding:
    1. To which he is a party, or in which he is interested.
    2. When he is related to either party or any attorney or member of a firm of attorneys of record for a party by consanguinity or affinity within the third degree, computed according to the rules of law;
    3. When he has been attorney or counsel in the action or proceeding for any party or when sitting in a case on appeal he as a judge in the lower court rendered or made the judgment, order, or decision appealed from.
    History: En. Sup. Ct. Ord. dated June 17, 1987; amd. July 29, 1987; amd. Sup. Ct. Ord. Sept. 13, 1988, eff. Sept. 13, 1988; amd. Sup. Ct. Ord. Dec. 5, 2000, eff. Jan. 1, 2001.

    Sounds like a good case for the United States Attorney General’s Office to assure Mike McGrath can’t cover his and Racicot’s tracks anymore.
    Montana what are you afraid of? The TRUTH?

    What you don’t know about the Montana Supreme Court is astonishing. None of this information is secret. Either do it yourself or have one of your do-gooder lawyers call the court and ask about the schedule. Ask when Beach’s appeal was classified (late January). Ask how many judges it’s been assigned to (five). If it’s not assigned to all seven justices, then, it’s not scheduled for oral argument.

    Anyone find it coincidental that since Mike McGrath was elected Chief Justice of the Supreme Court, that Barry’s case has been put on the eternal back burner?

    Take a look at the Supreme Court’s website:

    Look at the schedule for upcoming oral arguments. Every single case that is scheduled to be heard by the Supreme Court for oral argument was filed AFTER the last brief was received in Barry’s appeal.

    I read through the Supreme Court rules and procedures and it became very clear what has happened. It says that the Chief Justice will assign all the current appeals to a panel each week (Tuesday I believe it says). Once assigned, the panel will determine if the case needs to be heard for oral argument, dismissed, or just ruled upon.

    Well, since McGrath knows he will have to recuse himself from the case for his blatant personal prejudice against Barry, he is inflicting his own punishment by burying Barry’s appeal.

    I for one am not surprised due to the unethical behavior of McGrath in the past, but he is pushing the boundaries of judicial ethics pretty hard. Seems to me that maybe citizens should be filing judicial complaints against McGrath for unethical behavior as Chief Justice. Only problem is, from what I understand from the court’s rules and procedures is that he would have to assign that case as well. Wonder if that will end up in the trash can as well?

    Hmmmm…what a wonderful system! The police police themselves. The judges answer to nobody. And the politicians keep raping society. When are we going to stand together and fight the injustice of it all? When are we going to take back this land and make it once again the county it was founded as? What do we do?

    I see what you’re saying about the Judge, but I have a close connection to someone at the Arson Investigation Bureau, and I’m not sure how I feel about probation for someone who purposely sets a fire and kills someone in the process.     2134. I appreciate your response. It sure IS frustrating. I understand that things were different in the 80’s, but how many cases do we see where the case has been reopened with a whole new trial? Barry’s case should be looked at in a different light, especially since there is NO evidence that points that he was the killer. The poor families that have been through so much. It’s hard to imagine either situation; a daughter who is never coming home, and a son who is serving time for it. May they all find peace within.

    By the way, in response to the letter from the female inmate. She does have some valid points, but there are cases where I believe rehabilitation is not helpful, such as a child pedophile situation. There are other cases where inmates can truly be changed and deserve another chance. I don’t know what sentence June Enright is serving, so it’s hard to say.

    To 2132, I understand the frustration. I posted 2131 and all I was trying to point out was that back in the ’80s, you didn’t necessarily need evidence so long as you had a confession. Didn’t matter that the confession didn’t match real well. It goes to the mentality, “Well, he must have done it. Why else would he have confessed?”

    Once he was convicted, it’s a whole different matter. That’s why they’ve appealed and appealed. I don’t know how to hole the parole board, the Attorney General or the Governor to be accountable for this situation. How do you account for a man being sentenced to 100 years no parole for a murder when there is absolutely no corroborating evidence that he was even IN TOWN the night of the murder much less at the scene and involved.

    For the parole board to have made it’s ludicrous decision in 2007 as they did is one of those great mysteries like how the Egyptians built the pyramids or Stonehenge. Yet at the same time, since they made that decision, they should be held accountable for it and provide reasoning as to how this man continue to be held in prison with no evidence against him.

    On another note, I was in Billings over the weekend and saw a letter to the editor in the Billings Gazette from Thursday, June 18 — http://billingsgazette.net/articles/2009/06/18/opinion/letters/40-paroleboard.txt.

    The letter was written by an inmate in the women’s prison, but anyone following Barry’s case knows all too well how poor the parole board is. The content of the letter is provided below.

    Letter: Montana deserves better than its Parole Board

    The Montana Board of Pardons and Parole was created in Montana in 1889. Since then the Parole Board has evolved into a body of government that has more power than the governor. The primary goal of the board is to release inmates after they have been rehabilitated and served an appropriate sentence. This is not happening. The No. 2 board objective is “to make every feasible effort to bring about the rehabilitation of those inmates incarcerated or released.” There are many inmates who deserve their chance to be paroled.

    The Parole Board does not follow the recommendations of the prison staff in accessing the offender’s ability to integrate safely back into the community. Many offenders have done an excellent job of recognizing their mistakes and are eager to begin a law-abiding lifestyle. The quality of prison staff has improved a great deal since 1889, and this change is reflected in the treatment and rehabilitation of inmates.

    Taxpayers are throwing away good money after bad when the Parole Board will not recognize the positive change the prison programs and counseling have accomplished with the inmate population. What is the purpose of spending millions of dollars on rehabilitation, then refuse to recognize the hard work of both the staff and the inmate?

    Everything has an expiration date, and maybe the time has come to retire the Parole Board. The people of Montana deserve better than they are receiving under this antiquated board of “do nothing” but retry and reconvict a reformed inmate.

    To Mr. Brewer, to the best of my knowledge the following are the most accurate answers to your questions:
    Q- What did Barry and his friends do on the night of Kim Nees’ death?
    A- Barry Beach, Calib Gourneau and Shannon O’Brien split up approx. 630-7pm on 6-15-79. At that time, Barry Beach walked home alone. His sister Barbara saw him in bed at approx. 1230am.
    Q- What kind of car?
    A- 1970 Ford Ranchero owned by Barry Beach.
    Q- Who was with him?
    A- Calib Gourneau and Shannon O’Brien were with Barry on 6-15-79. At approx. 930pm, Calib and Shannon walked back to Poplar. Only Calib and Shannon know what happened between 630pm when Barry left the beach and 930pm when they left.
    Q- How long did they swim?
    A- Barry and Calib first swam at noon on 6-15-79 at Deigo Bend. At approx. 130pm they went to town to pick up Shannon. The 3 then went 1/2 mile NE to Sandy Beach. At approx. 530pm they attempted to leave but Barry’s car got stuck in the sand.
    Sandy Beach is approx. 1/2 NE of Poplar. The Train Bridge park is 1/4 SW of Poplar. It is approx. 1 mile between the airport and the high school in Poplar on Hwy.2.
    Q- Did anyone see him there?
    A- Centurion Ministries interviewed over 230 Poplar residents and classmates of Kim Nees and Barry Beach. Not 1 of the 230 saw Barry after approx. 730pm when he went home on 6-15-79.
    Q- Did he go back to retrieve his vehicle?
    A- The next day, Barry Beach was at his granddad’s ranch approx. 18 miles SE of Poplar. They branded cattle all day long. However that morning, Barry asked his mom, Roberta Clincher to call a family friend from the Chevy Dealer garage to take a tow truck down and get Barry’s car. This took place on 6-16-79 by the Chevy dealer.
    Q- What happened to the vehicle?
    A- On 6-11-79 Barry and his mom entered into an agreement with the Ford dealer to trade Barry’s Ranchero in for a Cutlass Supreme. Everything regarding the trade was in writing before Barry’s car got stuck on 6-15-79. On 6-20-79 Barry completed the car deal in preparation for a long planned trip to meet his dad in Louisiana.

    To 2128, I agree that there is no evidence pointing to Barry’s involvement in the crime in any way. Given the time of the trial in the early 80’s, having any kind of confession to the crime (coerced or not) led people to believe, “Well, he must have done it. Why else would he have confessed?”

    People today still don’t understand why a person would confess to a crime they didn’t commit. From reading the 2007 testimony, the murder had already seriously derailed Barry’s life by interfering with his ability to get a special clearance in the Navy.

    So, with the cronies in Louisiana coaching Barry to confess to the crime and go through the trial so that he can be cleared once and for all — after all, there was no way he could be convicted since there was no evidence connecting him to it… Then, by having gone through a trial and being cleared, Barry would have been able to live out the rest of his life having been cleared of the murder.

    If you dangle that in front of an angry 20-year-old whose life had already been severely altered by that crime, I bet there would be a fairly high percentage of young men who would falsely confess — just to end the interrogation and have the prospect of not having their life ruined further by a crime they didn’t commit.

What happened to Kim’s truck? if fingerprints were never lifted and it was destroyed, then there is no case.     ***Barry; his supposedly best friend and “blood brother” and Shannon O’brien; Calieb’s girlfriend all went down to the river to swim for a couple of hours. When they were getting ready to leave Barry’s car broke down and he alone walked back to town and home where he fell asleep. His sister Barbara is the only eye witness to this, but her testimony was refused by both Barry‘s original attorney and any law enforcement at the time of his arrest. Calieb Gourneau and Shannon O’brien stayed behind with the car. I believe it was Shannon’s testimony that she and Calieb stayed in the car on a very hot day with the windows rolled up and the doors locked for several hours. You can find her testimony along with Calieb’s on the website in the original trial transcripts.

    ***Following the vehicle is a dead end as it’s long been gone. You must remember it was 3 years after Kim’s death that Barry was coerced into that confession.

    ***It’s my understanding they were down by the train bridge in a sandy beach area where the car broke down. The way the drawings look it’s quite a way up the river from where Kim’s body was found and nowhere close to the party.

    ***Barry mentioned walking by “Head Start” on his way home in the confession. The Head Start building was not in existence when Kim was murdered. That should say it all not to mention all the other evidence proving Barry didn’t kill Kim.

    I’d like to know who those 11 unidentified fingerprints belong to! The number 6 in blood I’ve no doubt belongs to the owner of that infamous bloody palm print Mahlum and the crew ran hoops around to not identify.

    Following please find the May 14 article regarding the break in of the evidence room by an esteemed Roosevelt County Deputy. Seems old habits die hard! At least the current Sheriff took immediate action and fired the officer after searching his home in Wolf Point. So my hats off to him.

    I’ve no doubt had Bobby Carpenter the Sheriff back in 79 (Sissy Atkinson’s Brother) and the FBI officers done their job; searched Steve Grey Hawks residence they would have found the murder weapon the girls used to kill Kim with AND had Grey Hawk not been allowed to keep his job all those years I don’t believe Maude would have been able to continue her rein of terror on the community and kill 2 more innocent people besides Kim not to mention having taken Barry‘s life from him too. So the way it looks; Maude’s had a lot of help covering her tracks all these years not to mention Sissy, Joanne and the rest of the crew….

    I believe this is a good example of why Steve Bullock Montana’s esteemed Attorney General should look into Barry’s wrongful conviction, step up to the plate and set him free!

    What was taken? Cases tainted?

    A Roosevelt County jailer was fired from his job after authorities accused him of breaking into the county’s evidence room on April 20, Roosevelt County Sheriff Freedom Crawford said.

    Jared Weeks Combs, who had been on the job for the past five months, was immediately suspended from his job after authorities executed a search warrant at his residence in Wolf Point on April 21, the sheriff said.

    Information gathered from interviews and security tape revealed that Combs Weeks is the prime suspect, Crawford said.

    The FBI is assisting in the investigation and the case will be taken to court, Crawford said. “This case is a criminal investigation and we have been working with the FBI to get it adjudicated in court,” he said. “One bad egg will not tarnish the professional reputation of my staff.”

    The sheriff said he would be meeting with county, tribal and the U.S. Attorney’s office to see if the break-in will affect any of the cases, and that it will be determined on a case by case basis.

    Crawford declined to release what was stolen as it’s part of an “active investigation.”

    Crawford added that extra security measures have been implemented around the evidence room.

    The sheriff’s office underwent a makeover earlier this month. Crawford said the remodeling project had been planned before the evidence room was broken into. Crews repainted the inside, remodeled the front offices and installed new security cameras throughout the building.

    This is the second time an agency has helped out with an investigation at the jail. Last summer, the state Department of Criminal Investigations was called after two inmates escaped.

    Convicted drug dealer Robbie War Club, 48, a former cop who was later indicted for murder, left the jail along with Jessie Johnson, 20, both of Wolf Point. Johnson was found the following day at a Poplar residence and War Club was tracked and captured in Denver.

    Crawford said the circumstances that led to the walk away have since been corrected. A new head jailer was also immediately hired.

He continues to sit in prison for a crime he didn’t commit while he sees the death of his grandfather, grandmother, step-father, step-sister, uncle and step-brother along with others. He has had to hear news from prison guards about the brain anneurism of his father and heart attack of his mother. He has had to hear from family members the result of brain surgeries on his father, uncle and sister to see if they survived the surgeries. Sitting in a cell waiting to hear about life on the “outside” and not able to participate because of the cowardly actions of people responsible for the death of Kim Nees. All we can do is continue to pray for the truth to come to light and for Barry to be set free. Where is the justice in that? I implore the AG’s office to search their hearts for the justice in this continued imprisonment of the Beach and Nees families and take action to right this wrong that has gone on too long.

    I totally agree, BUT you have to have “another’s” prints, hair and blood compared to what evidence was found, which by the way the State of Montana has said they conveniently mis-placed all the evidence in their custody otherwise, Centurion would have been allowed to inventory when they requested their help in finding the missing evidence.

    Mahlum and those key stone cops failed to obtain and compare those people we all know were there and killed Kim to the evidence that was found at the murder scene. When that’s done then you will have the true killers of Kim.

    Roosevelt County authorities and Marc Racicot took the easy way out by manipulating a scared young man named Barry Beach 3 years after Kim’s brutal murder.

    Please, can anyone tell me if there were ever any hair, print or blood samples taken from Joanne or Maude? I don’t think so. The Key Stone Cops jumped hoops to avoid getting samples for comparison because they knew these two were GUILTY! All Mahlum ever did was come up with pathetic scenarios about what he thought took place when the entire time I believe he already knew.

    Montana stands by Barry’s coerced confession and I believe you have to have reasonable cause to request a court order to exhume a body. Autopsy showed Kim didn’t have anything under her nails etc. as the coerced confession stated she’d scratched Barry. There was however a broken gold chain found around Kim’s neck. Could that be to the necklace Maude, Joanne, and Caleb all told the attorney general’s office they’d found all at separate times?

    Since Mahlum and the rest of those covering the crime didn’t get any samples from Joanne, Maude and the rest of the gang that were there that fateful night there isn’t anything to compare samples to. That’s how Maude was allowed to kill yet 2 more innocent people and continued to terrify Fort Peck and why I believe Barry sits in prison today.

    I’d ask those who were there that night to speak out; tell the truth! If you didn’t participate, but witnessed Kims murder has it been worth being terrified all the years in fear of your life? Has it been worth staying silent? Hasn’t there been enough hurt? You know who you are and God help you!

    I’ve heard that in the 5/14/09 FORT PECK JOURNAL, which hasn’t been published on-line to date; there’s an article of interest. Looks like the Sheriff Department’s old habits die hard…

    On page 27 there’s apparently an article stating that a SHERIFF’S DEPUTY BROKE INTO THE EVIDENCE ROOM ON A CURRENT CASE!!

    I’d like to know if the deputy is a family member of a guilty party like Steve Grey Hawk is the father of Maude Grey Hawk Kirn in Barry’s case? Let us not forget Steve Grey Hawk broke into the evidence room in a judge’s chamber; which was clearly marked to stay out; claiming to go to the bathroom when there wasn’t one. Maude admitted to “only kicking Kim in the head” that fateful night, admitted to having Kim’s necklace in her possession after Kim’s murder and against a subpoena failed to appear at the BOPP hearing with not one consequence to any of the actions!

    I’ll be curious to see what was taken this time. The case is now tainted so what effect does this have? Another cover-up? Another innocent person sent to prison? Are they going to charge the deputy this time? Time will tell if it’s a re-take of Barry’s case! COVER UP???

    I’ve requested a copy of the article be sent to me so if I receive it I’ll post, but I’d appreciate it if anyone who has the article to take the time for the rest of us.

    Montana is still holding the evidence in Barry’s case hostage. Let’s all call, write, and e-mail Steve Bullock to allow Centurion Ministries access for that inventory they asked for! Put the pressure on and assure Montana hold’s these people accountable!!!

    I have written in the past about a “writing committee”. Being new to the blog I wasnt sure I should be the person making suggestions, but I don’t mind sharing what I’ve been up to. Check out Craig Watkins, District Atty of Dallas Co. He has established a special division called the Conviction Integrity Unit. The 1st of it’s kind. I’ve sent letters encouraging MT to establish the 2nd. I sent my letters to Steve Bullock, Gov. Schweitzer, Dan Weinberg, Jessie McQuillan both of the MT Innocence Project and State Senators Windy Boy and Hamlett. It might be a good idea for others to do the same. This division of the DA office should be in every state.
    Oh…and for the person who asked about the board’s Ms. O’Connor. She has(unfortunately)been reappointed.

    Jay Via cited numerous years of experience in various areas of expertise and the AG’s office just encouraged him in that testimony when truth be told, when Barry was arrested, Jay Via was new and gunning to prove his conviction record so prove that his new interrogation techniques work. I still wonder how they justify the fact that Barry “confessed” to other things under the known premise that “they have to prove you did it with evidence and since there isn’t any…you won’t and can’t be found guilty” and those “confessions” were proven false because Barry wasn’t even around or the real killers were connected with DNA but yet they continue to hold that the “confession” re: Kim is true.     For as many times as the Attorney General’s office has accused Barry of murdering Kim; I’d like for once to see the AG’s office come up with some solid proof.     Look at the case of Tim Cole in Texas. That poor man died in his cell before he was exonerated; but his family prevailed on his behalf. According to the statistics 235 innocent people were released from prison 33 of which were based on PROSECUTORIAL MISCONDUCT!! I’d say if someone looked into the Racicot and McGrath’s era they’d find a whole lot more than 33!

    Steve Bullock needs to read some of the transcripts his upstanding employee’s and the police work that was done on Barry’s case. It doesn’t take an idiot to figure out they intimidated witnesses and covered their tracks rather than doing their job of locking up the real murderers of Kim Nees.

    While waiting on the Supreme Court to assign Barry’s case and notify us all McGrath has recues himself I’ve been mulling over the AG’s statements they took before Barry’s BOPP hearing. Calvin Lester the poor man not only was intimidated as a child, but even now! Richie McDonald a bonafied part of the sheriff’s department was allowed to sit in with Pubell and Wellenstein during the interview with Mr. Lester! Um….wouldn’t that be out right intimidation of a witness? Not to mention the fact Mr. Lester apparently was in some sort of release housing where the interview took place. Yeah, Richie McDonald who lied under oath; for up close and personal intimidation then threaten Mr. Lester with his freedom too? That would make for a one sided statement if I’ve ever heard of one. Via taught his class well while visiting the fine state of Montana on a free ticket.

    Sure hope Mr. Bullock does his homework and cleans house. Barry isn’t asking for any favors just the truth and his freedom….God’s Promises Barry!

    Another birthday come and gone for Barry and we all grow older…except for Kim whose life ended early at the hands of violence. Memories linger of the horror surrounding this tragic display of aggression. Barry has lived most of his adult life behind bars for an act of aggression that he couldn’t have possibly committed. The evidence is proof of that. Several sets of footprints at the scene. Law enforcement corruption, government officials turning a blind eye to the truth right before them, even when testified to by numerous individuals. Manipulation of statutes and bylaws to meet their lack of moral integrity. Fear motivates it all. Fear that the truth will come out and wrongs will be made right. Fear that they will lose jobs. Fear from the real culprits that they will go to prison. Fear that restitution will need to be forwarded to Barry for this injustice. Fear that they will all by held accountable for their actions or lack thereof. The lack of action is as much a sin and violation of moral integrity as if they had committed the crime themselves. People were there the night of Kim’s brutal murder. People know what happened. People know Barry is innocent. People know what needs to be done to get Barry out of prison. People need to step up and accept the accountability and responsibility of their actions or lack thereof. People are living in fear of the consequences. Barry is in prison but these people are imprisoned by the knowledge they carry with them every day that they could right a wrong and free an innocent man. Only people of moral integrity will seek to right a wrong. Our expectations should rightfully be that we all want a “better world” but until people right existing wrongs then they are just proponents of the world continuing to degenerate. What is your belief? Do you want a better world or are you one of the people who are finding excuses to keep yourself from accepting the responsibility of your actions and facing the fear of the consequences? You may lose your job but is it better to lose your integrity. I’m speaking to all the politicians and culprits of this crime.     capital offense n. any criminal charge which is punishable by the death penalty, called “capital” since the defendant could lose his/her head (Latin for caput). By the legal definition Governor Schweitzer should render a decision and free Barry Beach; and held accountable for not doing so. Regardless of whether Barry signed a coerced confession or not hasn’t any baring on the governor’s responsibility to the office. Please 2091 if you’ve any idea explain exactly what the governor’s interpretation is and how Barry doesn’t fall under this? I’d be interested in knowing how these fine lawyers have gone about changing the definition of Capital Offense to meet their own agendas.

    I think if you look a little closer to the Montana Code Annotated, you will see that the section you are reading applies only to cases involving capital punishment. Since Barry did not receive the death penalty, the Gov’s office is contending that the Gov has no authority over the BOPP’s decision. Yet, and this is just my opinion, the MT code does not state that capital punishment must be issued. I, for one, might interpret the code to state that for crimes in which capital punishment “COULD” be used, this code applies. In this case it would apply to Barry Beach. But, as usual, our government likes to interpret law in whatever way that best suits their purpose at that time.

    Every letter I’ve written to the governor’s office concerning his authority to pardon Barry has been answered with “it’s up to the BOPP.”

    As quoted directly from the Montana Code
    46-23-301. Cases of executive clemency —
    ****The governor IS NOT BOUND BY ANY RECOMMENDATION of the board, but the governor shall review the record of the hearing and the board’s recommendation before granting or denying clemency. ****The governor HAS THE FINAL AUTHORITY to grant or deny clemency in those cases forwarded to the governor.

    As stated the governor does have the FINAL authority to grant Barry a pardon and IS NOT bound by any decision the BOPP makes. Did the governor ever publish a decision? If so can someone tell me where? I can’t seem to find it. If the governor hasn’t published a decision then where’s his accountability? If I’m reading the Montana Code right it’s his duty as governor to give Barry a straight answer rather than pass the buck isn’t it?

    Is my interpretation incorrect? If not then step up to the plate Governor Schweitzer! You and the rest of the world know BARRY IS INNOCENT!

    Dear Barry

    If anyone understands the debilitating dynamics of disappointment and despair, it is you. And if anyone knows how to help someone climb out of that bottomless hole, it’s you too! After losing to the legislature for the fourth time, I was teetering on the edge of terminal discouragement and futile rage when your Spirit-inspired and spirit-lifting letter came to me. Your kind and caring words kept me from tumbling over the edge and helped me to remember that God doesn’t call us to be successful; God only asks us to be faithful.

    As I write this on Good Friday, the image of Jesus being crucified on the cross certainly exemplified that seeming failure – his “mission” gone down the tubes, so to speak, and his beloved disciples running off in fear and hiding – not a very convincing image of a successful Messiah!
    Then I remember Psalm 22. Jesus was a good Jewish man whose prayers were the Psalms and I believe that He was praying that particular Psalm while He hung, dying on the cross. You are probably familiar with that too. It’s a great psalm to pray when all efforts seem to be in vain because it’s a perfect act of faith. It meets us where we are – “My God, why have you abandoned me?” — and takes us to where we should be: “Generations to come will be told of the Lord that they may proclaim to a people yet unborn the deliverance you have brought.” Jesus knew that psalm restores hope in a loving, faithful God who will never fail us nor forsake us, no matter what our life looks like, how it feels, however silent and absent God seems to be.

    I bet I prayed that Psalm 22 hundreds of times during the fifteen months I had to wait to finally learn of Susie’s fate. It got me through each hour, each day, each month. And, this time, your compassionate, encouraging words got my feet, my mind and my spirit back on track, God’s track Barry! Thank you so very much!! You may think you’re stuck in a tiny 7 x 9 foot cell, but your reach is miles and miles beyond that ugly barbed-wire fence. I praise God for the gift of you in my life, Barry!! May you enjoy many Easter blessings and may you always experience Resurrection Life, no matter where you are!

    Has anyone ever contacted the US Attorney’s Office in Montana concerning the State of Montana’s obvious disregard for the United States Constitution and it’s citizens?

    Montana obviously doesn’t care whether your from Louisiana or Montana just as long as they can lock you up without any evidence.

    Barry Beach was a resident in Louisiana when they coerced that conviction out of him and then took him to Montana. Seems to me if Via and Calhoun broke the law in Louisiana then Roosevelt’s finest and Racicot in Montana for what they did to Barry then and for the last 26 years that’s a federal issue isn’t it?

    The feds need to call in the CDC and CLEAN HOUSE IN MONTANA!!!

    Representatives of Montanans For Justice, including a former state senator and current state representative met this week with Montana’s Attorney General, Steve Bullock.

    The group met with the AG with the desire to show compelling reasons why Barry Beach’s case should be looked at again and to push for a new trial in consideration of the upcoming Supreme Court decision.

    Montanans for Justice feels that the meeting was productive and that our new Attorney General gave us his full attention. While, Mr. Bullock made no commitments, he was extremely generous in giving his time and attention.

    The group stressed several key issues, including the fact that none of the evidence points towards Barry Beach and actually shows another person or persons were involved, that the confession is significantly at odds with the physical evidence and that the interrogation and subsequent confession were made under highly dubious circumstances, that the Board of Pardons and Parole’s decision seemed determined in advance of the hearing and that the Department of Justice should seek the truth for justice’s sake and that of the department’s credibility.

    It is the opinion of the group that Mr. Bullock left the meeting with new awareness of the breadth and scope of the exculpatory facts of the case and the level of public interest in the case. We are hopeful that our new Attorney General will look further into the matter, see the injustice involved, and help correct this miscarriage of justice. We are encouraged by the AG’s sincerity, openness to hear us out and what appears to be quality in his human character. We will keep everyone updated as we learn more.

    PHOTO of it on the pickup.. so pretty hard to run it and it would have to come from Roosevelt County and that will never happen… No fundraiser is going to make any difference. Did you know that the BOPP and Brian Schweitzwer never even read a single letter from the previous letter writers?? NOPE not one and they won’t-that is why they have the mail to go through so many places before it is even decided IF the Gov or head of BOPP will get the letters….I know this for a fact, I have a friend who works in the Governor’s office.It is sad, Barry deserves to be free but it takes PROFESSIONALS who have the means, education and connections to others who can make this work.. Alot of what happens and is NOT part of Centurion and M4J makes Barry look like a circus act and if you truly care, just support those who do the real work and when GOD is ready for Barry to be free.. Barry will be free.First he has to stop all his lying, manipulating and conning people.. this behavior will never get him free..nor will all these goofy people who are doing things that make this hard on the professionals and the legal experts.

    I have written Senators Windy Boy and Hamlett asking for direction in changing the clemency statute. As soon as I hear from them I will let you all know.
    In the meantime, Barry’s case is before the MT Supreme Court and we all need to focus our prayers on God working a miracle through these judges. A decision should be made the week of March 23.
    We all need to keep Barry and his family and the judges in our prayers.

    Hi all..I’m new to blogging and don’t want to step on any toes but did want to share a letter I received from Gov. Schweitzer. In a nutshell, he says “pursuant to MT statutes, as Governor, I may not grant clemency unless the BOPP recommends to me that clemency be granted. Therefore, there is no action I can take regarding the clemency application.”
    Any suggestions on a next step??

    Basically, there was an indication that the Supreme Court would make a ruling within 6 months which would be March 24 or so.

    As much as I have felt so bad for Barry, I feel even worse after reading “The Innocent Man” by John Grisham. (Someone may have mentioned this book earlier?) It seems that breaking men down to admit to a false confession is far too common of a practice. I couldn’t help think of Barry the whole way through this book. May God bless him. My gosh, can’t authorities reopen this case? There is no evidence against him!

    I want to wish Barry a happy birthday! I only learned of Barry and this tragic story last April when I happened to catch the Dateline special. I grew up in Eastern Montana, and when I realized what I was seeing on the TV and where it happened, I was very interested. Now I am outraged! The truth is out now and there is no changing it. Unfortunately, our justice system doesn’t seem too interested in the truth. It seems they only care about placing blame wherever it is convenient.     # 2010 - “Time-barred” does not apply to the guilty who have not been charged in this case.

    I believe we should be encouraging the justice system to bring the real murderer’s to justice. The evidence is there to prove that more than one person was involved in the murder. Since no one has offered testimony to put Barry at the scene, lets go after the people that were at the scene. Bringing those to justice will free Barry and “time-barred” will no longer matter.

    In the letter writing just push the point that more than one person was involved in the murder and we want them charged. In the end, the guilty people will show that Barry is innocent. We have the right to demand that the “REST” of the people involved be charged.

    Is there any evidence available or is it only pictures of evidence? With Tim Master’s a special prosecutor from one county indited the DA from another? One newsoutlet reported:
    In fact, the evidence—and how the Larimer County District Attorney’s Office handled it more than a year ago—was at the heart of a January 2007 defense motion to disqualify the DA’s office due to allegations that they intentionally tampered with it so that it would be useless in identifying an alternate suspect in Peggy Hettrick’s brutal 1987 murder and sexual mutilation.

    The district attorney was accused in court papers of stealing the evidence so that it could be tested by means that would degrade and destroy the sensitive samples, thereby making it more difficult, if not impossible, to extract usable DNA in future tests.

    David Wymore, Masters’ lead attorney, said that it’s lucky DNA testing returned viable results at all, considering how the samples were retrieved from the clothing … but even then, the prosecutors did not compare the results of their tests to all the suspects who had given DNA samples to investigators two decades ago. They concluded only that Masters was not a match to any of the male DNA found on Hettrick’s clothing.

    It was the defense team—not the prosecutors—that made those full comparisons and determined the DNA pointed to her former boyfriend, not to Masters.

    Once the defense’s results were confirmed, it was enough to finally convince special prosecutors from Adams County that Masters deserved a new trial, if new charges against him are filed at all.

    While that’s what Masters’ lawyers have been trying to accomplish since 2003, Wymore said that had the Larimer County DA’s office not mishandled the evidence in November 2006, the testing may have produced an even clearer picture of the events surrounding the murder.

    “last night and had on National Geographic Ch 796 and there was a special on the “Science of Interrogation” and the few minutes i saw was all about coerced confessions with some video taped interrogations and a PhD from California somewhere who seemed to be an expert on coerced confessions and spoke of the hundreds of documented confessions that have been documented to have been coerced of false confessions. ….. one hour in length and it goes into tried and true interrogation techniques as well as more intimidating methods.”

    There’s been a lot said on this blog about Barry’s personal life lately and to tell you the truth, none of that’s important. What is important is helping Barry, one of God’s children. I’ve only known about this case and been corresponding with Barry for a little over 6 months but have found him to be a kind, humorous, intelligent, God fearing man. Like the rest of his supporters, I find it difficult to deal with the fact that the authorities continue to turn a blinds eye to what is so obvious; that the evidence does not support the claims of the confession. After all, Barry confessed to a 2nd murder of which was proven that he could not have committed. Wouldn’t that alone raise a huge red flag that he was clearly disoriented and confused at the time of the confessions? I pray that one day, someone, somewhere who has the power to release Barry, will realize that a man’s life is of far,far more value than the stigma of being a self-important politician. Like the rest of his supporters, I find it difficult to deal with the fact that the authorities are turning a blinds eye to what is so obvious, that the evidence does not support the claims of the confession. After all, didn’t Barry confess to other murders of which was proven that he could not have committed? Wouldn’t that alone raise a huge red flag that this man was clearly disoriented and confused at the time of the confessions. I pray that one day, someone, somewhere will realize that a man’s life is of far, far more value than the stigma of being a self-important politician, especially in God’s eyes.     There’s been a lot said on this blog about Barry’s personal life lately, and to tell you the truth, none of that’s important. I’ve only known about this case and been corresponding with Barry for a little over 6 months, but have found him to be a kind, humorous, intelligent man(even given the fact that he’s a Redskins fan)but more so, he’s a very God fearing man.
