Dateline NBC Feature - April 4, 8pm!

The long awaited 2 hour Dateline NBC feature about Barry Beach’s plight is scheduled to air on Friday, April 4, 2008 at 8-10pm MDT!

Dateline NBC has investigated this case thouroughly and will not be revealing any evidence against Barry Beach…because there is none!

Be sure to watch this national coverage of an injustice we face within our own state.

    9:00 a.m. – 12:00 p.m. - Make posters for rally; hand out flyers around town, place

    12:00 – 1:30 p.m. – Sack Lunch (you bring) at Lockey Park. Take the Capital Street
    Exit, when traveling west on Prospect Ave turn South (left) on Lamborn Street, travel 5 to 6 blocks you will run into Lockey Park. This park is close to the Capital Complex and is boarded by Broadway Street and Lockey Ave and Lamborn Street.

    1:30 - 2:00 p.m. – Assemble on the front steps of the Montana State Capitol building.

    2:00 - 3:00 p.m. - Justice for Barry Beach” rally.

    If I was Eddie I’d be knocking on an FBI door telling them everything. Sissy Atkinson has proved over and over again that she can get away with everything. Couldn’t you just see her going to and putting all the blame on Eddie, Maude and Joanne. Those women will stop at nothing and I think now that they know that this case is not going away and that it’s here to stay, the pressure, the publicity, etc will get to one of them, and Eddie will be the one they set up to take the blame. Eddie you need to come clean!

    I would think that Joanne Jackson would come forward because sooner or later one of them will break and one of those women will talk and their going to protect themselves and try to hang it all on the others. You’d think that Joanne would try to protect herself first as well. Instead of always taking orders from Sissy. One of them is going to get a much lighter sentence if any at all if they just cooperate. This isn’t going to go away, they will never be free of it. I don’t know how a woman could live knowing what she did, knowing the whole town knows, knowing that they were an embarassment on national television, knowing an innocent man sits in prison, knowing that she’s going to hell for this.

    You know I have to say something in regards to Joann. She seemed to have it somewhat together. At least she didn’t look all messed up like Sissy did. If Joann came forward, her attorney certainly could ask for a lighter sentence or maybe none at all depending on what her part was in it. But for now she will carry that with her and it has to eat at her every single day. Kim will hang over the shoulders of all who committed and all who have covered this up the rest of thier ever breathing days.

I know Joann lived in Missoula for several years and low and behold as soon as she was questioned AGAIN she and her family packed up moved back to Poplar, I always thought that was interesting! the more I investigated,I think the plan was that if they stick close together no one will talk.     It certainly has brought a lot of attention to the case, but there are many folks who did not see it. These folks are now hearing about it and would like to see it themsevles.

    If there is a way to get Dateline to air it one more time that would be great.

    I am wondering where the records clerk is that supposedly erased the taped confession. I would like to talk to that person to find out what the actual protocol is on tapes of confessions for out of state cases. I think Jay Via is full of it personally….     So, Maude is married to Dana Kirn. Maude confessed to Dana that she helped kill Kim Nees. Maude and Dana begin a bitter divorce. Dana plans to use his knowledge of the murder as leverage against Maude. Maude has her boyfreind, Tracy, kill Dana. Tracy is doing time for murder. Maude has since moved on to a new boyfreind……..Has any one tried to talk to Tracy?

    IDEA: Dateline set the stage for the American public to HEAR and SEE some of the case. But there are to many questions that the folks around the country wanting answers for . I think they should get 20/20 to do a follow up now. More coverage! More intense interviews. I’d like to see them interview the following:

    Ask Steve Greyhawk just what he was up to and the same with Sissy’s brother

    Ask Governor Schweitzer why he hasn’t stepped in and taken care of this matter and what he intends to do?

    Ask Marc Racicot WHY he would mislead a jury the way he did?

    Maybe even interview Clinton and Obama and ask them just what they intend to do if anything if they are elected? We know that McCain won’t do anything - for the love of God he’s a Republican and so was Marc Racicot and Marc was very close with Bush and so we know why Bush hasn’t’ stepped in.

    Interview the FBI who apparently were involved?

    We need more coverage on this case - more national coverage.

    It’s an election year and would be a GREAT time to put some of the politicians in the “hot seat” and ask questions!

    Nobody does it better than Barbara Walters or Diane Sawyer!

    If they can keep the media going - and get more people to watch something like 20/20, it would spark more interest.

    I think we should all write to 20/20 and ask for a follow up to the Dateline investigation!!!!

Why not give the little crackhead some good dope and listen to her carefully. I hope that justice will prevail and the D.A. and the Sheriff and all else involved gets what is coming to them. What about any reasonable doubt? and life without parole. I hope that there is one honest federal investigator out there looking into this, cause there is sure some dishonest public figures in Montana. The Jury of peers? How can these people sleep at night?     IF all she did was kick her in the head- then WHY 25 years of cover-up. Has she ever gone forward and made a statement that she WAS there?

    Why didn’t Maude show up at the hearing? Why didn’t Maude speak to Dateline herself?

    If all she did was kick her in the head - then why doesn’t Maude do the right thing NOW - call Dateline - give a statement - better yet get an attorney (not from Poplar either!) and sure has heck don’t go to daddy for help! He wants to save face too!

    Why not be the first of that group to give a TRUE confession and statement - get a lesser sentence - do the plea bargaining - then nail those other girls. Before they nail her! Because that’s JUST what is gonna happen.

    Someone is going to want the honor of being the first to come forward - think they care about Maude? Seems the whole town knows Sissy did it - seems the whole town believes Maude did it too. So a few simple kicks to the head - that’s just a beating and not a murder - so if your a friend of hers - I’d HIGHLY recommend she comes forward before someone else beats her to it! Those other girls are trash - thier slime and slime only runs one way…..down hill! If Maude ONLY kicked her in the head - don’t let those slimeballs taker her down - get her to come forward first.

    This is coming from someone who has never been to Poplar - I had to look it up on a map the other day. From someone who didn’t know a thing about this murder until Dateline aired it.

    But this isn’t over - it’s never gonna go away. In fact its only going to get bigger and bigger with more and more plublicity. I’d want it over and to quit hearing my name dragged thru the mud.

    I had a friend once who went thru divorces. The first one she was taken to the cleaners, but he was the one who filed the divorce. The second time she got smart, she filed first It’s always more fun to win than to lose. The girl that comes forward fist will win, the others will lose.

    I’ve never even heard of this case before Dateline aired it, but I know from past experience that it’s best for Maude to come forward before someone else does. Maybe even her father. I heard he is trying to be a preacher. There are good preachers and bad ones. Just like good cops and bad cops. Well he’s proved he was a bad cop, but just maybe he’ll decide to be a good preacher and confess to his daughters involvement. I wouldnt’ trust him either! I’d beat daddy to the pulpit and come clean!

    Well, what is very revealing as to the fact that they are covering things up is that they believe that they are correct beyond the shadow of a doubt. I noticed that when they are asked if there has been any doubt about the conviction that has crossed their mind they don’t answer the question. The guy that claimed Barry Beach was “speaking from his heart” when he made the “confession” revealed himself right there. Why can’t he see this today in Barry Beach when it is so very obvious to everyone else?

    The Montana Municipalities Insurance Company told a town in Montana that if their Chief of Police messed up again, they (the insurance company) would no longer insure the town. The Chief of Police was suspected of being incompent in his duties a couple years later. Did the town fire him? No, he was moved to the Sheriff’s office as Deputy County Sheriff. More power, larger area, more problems.

    This is a small example of how “the good ole boy system” works.

And when a prosecutor has more confidence than intellect they help keep the tribal police wallowing in incompetence if not outright illegality.     Why have the fingerprints and hand print not been run through AFIS? I am in law enforcement and believe that the evidence shows beyond all doubt that Barry Beach is NOT the murderer of Kimberly Nees. AFIS, for all that don’t know, is the Automated Fingerprint Identification System. All law enforcement (FBI or MT AG’s office) has access to it. If the murderer(s) have ever had their fingerprints taken, they will be in this system. From the looks of Sissy Adkinson, Joanne Jackson and Maude Gray Hawk, they have been to jail at least once and would have had their fingerprints taken. With a positive match, we have a prime suspect and then people will start singing like a canary. Case solved. Innocent man goes free. Guily go to prison. Society is a little bit safer while we sleep.

    come on people. i talked with my dad and he said back in the day when a & s was going strong, the oil business was still booming and the bars were full almost every night it was pretty crazy. he told me about a place called “beer can flats” and another called the “end of the pavement” and even “bloomer hill” i guess when a & s was going strong, there were 3 shifts going 24/7. i was afraid that poplar was going to be made out to be worse than it is. he told me that there were a few unsolved murders around that time and it was pretty wild downtown and he said there were great big beer parties all the time.

    now these people who have come forward with “evidence” well seem to be in the same boat that you people portray ms. atkinson, jackson, and gray hawk.

    richard holen-convicted felon, dun oconner-convicted felon, vonnie brown-convicted felon, carl 4star-drug addict, alcoholic, mental patient, and the other mrs. gray hawk-reportedly bad alcoholic. did you people ever stop to think that these people would ever have any credibility. as for the palm print, did you people not hear that all of the listed suspects gave palm prints and none matched. what mahlum said made sense because of the people who live on the hill could have walked down there and picked up something bloody and put it down, got up and ran. fearing that they may be questioned as a suspect stopped them from coming forward. that kind of makes sense to me because the truck nbc put down there got vandalized too.

    to me mr. beach will never get out and this is a waste of time so i’ll never comment on this matter again. it will get appealed to the montana supreme court and united states supreme court-again-get shot down again and everyone will be madder than ever.

    i would not dis mr. racicot and any other important people-because it just makes them angrier and they already hold all the cards and by making them angry, powerful men in high places is scary. it seems to me that you guys are just digging mr. beach in deeper.

    so i wish you supporters the best and don’t be so angry and full of vengance because it may come back on you one day. isn’t that what they call karma.

    Yeah it’s pretty obvious-he is innocent. Aw hell, you all know how it is on the rez!Family feuds can go on for generation to generation. People can hold a grudge til their death bed-even if they are in the wrong-their pride and stubbornness will never allow them to admit to the truth. There are a LOT of secrets that a LOT of people have on the rez that they are not willing to talk about. It’s just a fact of life-and it’s not just about the Beach case either. It’s much easier to try to forget about something and pretend it never happened, than it is to open up a can o’ worms and say the truth. Sad but true. Yeah the Dateline show just made the tribal, county and state of Montana police and judicial system the laughing stock of the nation. Pretty sad to see how the ‘good ole boy system’ is being run-even on the state level, but not surprising.

    I watched it,,, the thing that got me the most is that Richie MdDonald, a sherriffs deputy lied in court. At that time he worked iin deep draw where there was a lot of machineery. I worked in netting where it was quite, you could hear the crikets all night long.
    So for my not hearing anything, well McDanals is a lliar,,, Hell last stampede weekend while he was on duty he pointed me out to one of the atkinson kids, I wound up in a fight with him and two of his friends…….. Now the sheriff even just stood there. Arent they supoosed to protect and serve?

    My opinion is that there are WAY too many unanswered questions. And for pity’s sake, how can anyone believe that there is absolutly no evidence that would prove that Barry Beach is innocent? It seems to me that all the evidence was bungled and or tampered with. Seriously!! My opinion is that this was a very high profile unsolved case that helped our former govenor get his political career boosted. I think that there is a very vested interest in keeping the truth covered up, be it political or otherwise.

    Personally I think his legal team should give up on Montana doing anything and go to the Feds. Why?     I don’t think I can decide whether or not Barry is guilty from an obviously biased TV program, but who cares? This obviously goes far beyond reasonable doubt. It is well-known that a jury is more likely to convict an innocent man than let a guilty one go free. This is especially true for violent crimes, which play off of their emotions. Never forget the importance of “innocent until proven guilty”, because prosecutors are far too good at what they do.

I’ve heard nothing about the case until last night and am stunned and saddened to see that an obviously innocent man is still behind bars. If after watching a two hour program I am convinced of his innocence it is incomprehensible that anyone with an ounce of common sense can keep him in prison. Racicot is an embarassment and clearly had a hand in the parole boards blatently biased decision.     Hmmmmm, Louisiana officers, when I say the first word that comes to my mind it is CORRUPTION. They have been exposed over and over again for this. Not just one department but many. I am so sorry for Kim’s family that the murderers are still out there (in my opinion) The truth is that the words justice mean nothing to lawmakers, officials or “peacemakers” anymore. It is a word they hide behind to make themselves feel grander, more important and wealthier.

A classmate of Kim’s a victim of this terrible crime and I even knew Barry back in the day and some of their family. I always wondered why noboby said much. I have no information to offer because I never gone back to Poplar except for brief visits. Now I know a evil secrect is living there. I pray today that this nation responds to this website. The ex Govenor the ex cops the judges the parole board yes they need to be investigated. Other people charged with murder get lighter sentences and even get released after so many years.     Agreed Texas, it’s amazing what difference there can be between the Justice System and a Just System. . . not to mention actual justice! It seems to me that one of the major faults in this system, as in most other legal systems, is that procedurally the BOPP likely is limited in what they can consider when making their decision. When the case is re-considered, the board must follow specific guidelines of review. This may tie their hands (complicitly or not) to a great degree. For instance, a quick at the original case indicates that a detective Via testified that Barry confessed in presence of counsel. (Beach v. State, 217 Mont. 132, 705 P.2d 94 (1985). Apparently, this is testimony which was not refuted during trial. Appeals specifically mention that claims of duress, coercion, etc. are negated by this supposed confession! Obviously this is one of a multitude of problems with this conviction. I have not delved too deeply into Barry’s case, just the program and til now, but it seems difficult to believe that in this case agenda outweighed justice. And, it appears to have served Rasciot well. No surprise he is the president of an insurance lobbying group!

They can’t exonnerate Beach because it would embarrass Racicot. He’s as good a liar as that drug addict who was likely involved in the murder. He probably thinks of her as scum of the earth, but they’re the same in my books. I wish to God this country’s citizens would drop everything and mass march to Washington, shut the country down, refuse to work or pay bills. I left Montana in 1991, but I am always bragging to people that I am originally from Montana and telling them how one day I hope to move “home”. But now I am embarrassed to even say I am from Montana. Boy, people must really think that Montana has no justice. Like I stated above I had never heard of this case until tonight and just what I have learned in this short of a time period I am convinced that Barry is innocent. This case is really showing how backwoods and reckneck the justice system in Montana really is. It make us look like fools. Makes you wonder how many innocent people in MSP are there. Come on people there is NO evidence against Barry other than some crooked Louisiana cops (and I know for a fact they are as I have lived there also)who made up a story to get some short lived fame. This is ridiculous why wont Montana let them retest the bloody palm print? To me this sounds like they are scared it may reveal something they do not revealed. That right there will prove who was at the scene. Come on Montana justice quit looking like hillbillies and do the right thing and let this man prove his innocence and put the REAL KILLER behind bars.

Maybe not now, but you seem to have an above average intelligence. The more you look, the more you will become sure. Our problem is that most people in our world do not have an open mind.     Ok, I guess I couldn’t resist checking for any responses. I have to concede that you make two very valid points that I do agree with very strongly. If there are four individuals that truly are guilty and they have eluded justice for these many years than the Nees family has only perceived that they received justice with Mr. Beach’s conviction. The state may be hesitant to re-evaluate the evidence for fear of re-opening these old wounds for them. However, as I try empathize with what they have likely been through over the years, I find myself believing that I would feel worse if after all these years an innocent person was forced to sacrifice their freedom so I could feel comfort for my loss.

    You can’t put a price on justice. If this other evidence is valid and can be tested against the other subjects and would incriminate them…we have a duty to do so in the interest of justice.

    While I am still not convinced of Mr. Beach’s innocence…you have convinced me that the case should be re-visited in the interest of justice for all.

    Your organization can claim a small success tomorrow evening. Many Montanans I have encountered through work and in the community are talking about Mr. Beach. You have established a forum and many that were oblivious to this issue are now taking interest. Not all are going to share the views of Montanans for Justice…but you have succeeded in getting people to take notice and discuss it with one another.

    I will be watching tomorrow evening as, I am sure, will many others.

    You know, IF Barry Beach had committed this crime, he could have told good ol Mark Rasciot that back in 97′ when Rasciot offered him his freedom if he would just say he killed Kim… but Barry knows he did not kill Kim, so he told old Rasciot where to take his offer..     You have written a well reasoned post. As a member of Montanans for Justice I would like to clarify a couple of points though. Clearly we as a group are biased that Barry is innocent of this crime. This bias was only arrived at though by study of all the facts. We have attempted to post all the facts and documents, including the states responses unfavorable to Mr Beach, on this site. The confession has to be viewed in the light that the skilled Monroe, LA detectives extracted confessions from Mr Beach on two local murders when he was proven to be out of state. These detectives then skillfully extracted false confession for the same murders from another individul who also was exonerated. This coupled with Mr Beach’s confession not matching the crime scene casts extreme doubt on his guilt. I think we would however doubt his innocence if evidence tied him to the crime scene. The evidence gathered initially was voluminous and NONE mathes Barry Beach. So a faulty confession IS all holding him prison. Lastly you cannot discount the multiple statements made by the true suspects over the years. If Barry Beach and the Nees family are to recieve justice then we have to punish those truly guilty. There is still evidence available to test against suspects but the state resists. Why? If Barry is guilty why not test that evidence and put this to rest.

    I can’t help but make a comment here. Normally, I just mind my own business when I see two sides passionately flaming each other over topics that they are purely speculating about. I truthfully have not followed this case other than glancing at the stories in the local newspaper as it has been high profile as of late. I do work in community corrections and the concept that convicts are very adept at lying is not exactly a revelation to me. However, I have noted some important points of my own for both sides here. ALL GOVERNMENT CONSPIRACIES ASIDE:

    The evidence presented on Beach’s behalf does have significant merit. I am skeptical, however, as the only source I have read is this website and it is obviously focusing heavily on Beach’s innocence. So, the presentation is naturally going to be biased. That being said - It is my opinion that those of you supporting Mr. Beach do have a legitimate right and demand to have the legality of this conviction examined. The physical evidence in this case does not appear to point to Mr. Beach…but does not necessarily exonerate him either.

    Mr. Beach’s “confession”, coerced or otherwise seems to be the source of much of this debate. The fact that he claimed to not know anything the first time he was questioned is irrelevant. Quit arguing about that. It is pointless. Guilty or innocent, that interview would have been the same result. It proves nothing on either side. The fact that his confession taken in Louisiana does not match up to the crime scene should have intrigued even a mildly intelligent investigator to delve deeper. However, it is not concrete evidence of innocence. Time had passed…details fade in one’s mind. Crime’s of passion are not pre-meditated and details can be missed in one’s mind. More importantly, there is no documentation establishing that Mr. Beach was not under the influence of any alcohol or narcotics the night Ms. Nees was murdered. Details would be lacking if he was intoxicated…but he damn well would have known he had murdered someone that evening.

    Most importantly, the section titled “the likely suspects” is crap people. Most of the evidence presented there is hearsay and it is coming from a majority of individuals that can be established through the Montana CONWEB and the BOP as drug addicts and criminals. One of the people cited as a source of information is a sexual offender. Hearsay does not stand up in a court of law and these people are not reliable. Sorry!

    Mr. Beach, however, does appear to have some credibility. As far as I can tell, he had no prior felonies and this is the only offense on his record. The investigative focus that was targeted on him based on his confession, coerced or otherwise, and the sentence he ultimately received does certainly seem like the poor man may have been railroaded.

    Law enforcement did not have the investigative techniques in that day that we have now. Would he have been cleared as a suspect if it happened today? No one could possibly know. Small town sherrifs still aren’t qualified to conduct lengthy investigations. Don’t even get me started on Tribal Cops. For those that are dedicated, I apologise, but the majority I have read reports from and interacted with are a joke. One would see more proffesionalism from a loss prevention officer at Target. I don’t discount the claim that those guys look out for their family first one bit. We see it first hand all the time here in Montana.

    Bottom line and brass tacks…from the BOPP and the Supreme Court Point of view, Barry Beach has had decades to study his case with little else to distract him. He wouldn’t be the first inmate to make enough claims to muddy the waters enough to convince people to champion his cause for him. Short of a major discovery and introduction of evidence that shifts the proponderance of evidence to to the point where there isn’t a shadow of a doubt about his innocence, he will remain an inmate. All that anyone has accomplished is to question the legitamacy of the evidence that convicted him. If his legal counsel was worth anything it should have been done in the trial. Even a deathbed confession without direct evidence to legitimize the claim is practically worthless.

    I am not convinced that Barry Beach is an innocent man, but I do hope that if there is solid evidence of genuine credibility to be found to prove his innocence, that it happen before he has lost any more of his life at MSP. If Barry Beach is an innocent man…then the person(s) responsible for taking Kimberly Nees’ life also took his.

    Last comment…it is a shame that in all of this controversy, almost everyone has lost sight of the confirmed victims…Kim Nees’ and her family.

    I won’t be checking back to see how many of you feel compelled to flame my comments as this is truly my objective viewpoint. So don’t bother. If you want to argue the points I raised than do it in a constructive way by helping Mr. Beach find a way to put these questions to rest publicly somehow.

    Thirty years I commend your service to your community. In thirty years have you or anyone you know in law enforcement ever mishandled evidence for lack of training etc? Well that kinda thing happens. But a deliberate act of destroying or removing evidence from a evidence room would not that be a felony in the State of Montana?. How do you explain this as a law officer. I would suspect that a a large majority of law enforcement wouldn’t do that but someone did and nothing has been done about that? Barry’s case should have been thrown out of court. A honest judge and DA would have done the right thing. If evidence of him being at the scene of the crime was there… From what I can see nothing puts him there but a coerced confession years later. I pray it was thirty years of honest police work.

    Beach’s supporters are so naiive that it’s pathetic. I pity you, in a way, as you’ve been led down a road by a modestly skilled attorney looking for a step up on a lackluster career ladder.

    I’ve been a law enforcement officer for thirty years. That said, I don’t have a predisposition to “throw them all in jail.” I can, however, tell you that everyone serving a life sentence in MSP claims to be innocent. Everyone on death row was wrongly convitcted. Just ask any inmate. Sure, there have been, and are, inmates who are innocent. Beach, howvever, is certainly not one of them, based upon evidence as that term is defines by law.

    Barry just got tired of MSP. Although he claims that his confession was coerced, he waited all this time to complain. Anyone granted a new trial after years have elapsed can expect a better outcome; not for society, but for himself.

    Of course, Barry found Jesus, as did so many folks who are on this bandwagon. Folks who believe in Jesus are the ones most easily led, as they are “followers,” per se. The fact of the matter is that you don’t have the kind of scientific evidence here that mandates a new trial. The courts will deny all of the appeals. Wanna bet? Oh, maybe Jesus can add a post to the blog and enlighten us.

    Wow. I just read Judge Cybulski’s denial for new trial. It was extremely short and without any reasoning explaining his decision. I then read the information posted by the law professor in #67:

    Why is it that someone brandnew to the facts of the case and without any personal stake takes the time to give a well reasoned analysis and the judge getting paid to make decisions can’t write more than two poorly reasoned paragraphs hastily penned to beat the response from Mr Beach’s Attorney? Judge Cybulski seems to fit well up there with the rest of the Poplar Third World Justice System.

    Another miscarriage of justice in the long line of disappointing decisions made by our elected officials. At what point does this become a case of right vs wrong and no longer a case of political self-preservation? There is no way to give a man back 25 years of his life but the least they could do is let Beach start a life at this stage of the game. Fear of retribution for taking a man’s freedom as well as the failure to admit fault and mistake should not be a motivator for keeping him locked up when he is innocent. Take a good look Montana. As a taxpayer, I wouldn’t want a person with that lack of moral conscience on my “payroll”.

    Just remember, this isn’t over. There is still an appeal to the Montana Supreme Court, Federal Court, Federal Appeals Court and the United States Supreme Court. This one is coming back. I think Judge Cybulski (or whatever his name is) made several serious errors in his ruling. The upper courts will never uphold his ruling.

    Yeah, I see the judge denied the petition. Did you read the denial??? It is crazy. First of all, the judge made a ruling without even getting Centurion’s response to the AG. I think that makes it a biased decision because he didn’t get both sides of the story. Second, this judge must be out of his mind! He says that just because the AG’s office has ‘thoughoughly reviewed the evidence and again interviewed witnesses’ and since the AG’s office did not seem convinced of Beach’s innocence, that he must deny the petition. What planet did this judge come from? Ever heard of a corrupt lawyer? Where do we get all the lawyer jokes? Just because a prosecutor (AG) SHOULD seek justice and not simply convictions, does not mean they do! Basically, he is saying that since the AG is good with it, so is he. What a justice system!

    Just wanted to point out that the reason the Louisiana detectives had to admit to two of the confessions they garnered as being false is because Beach was out of the country overseas in the Navy on a ship fighting for the freedom of his country for one of the murders and out of the state of Louisiana during the other so they had to admit that those two “confessions” were false yet they won’t admit to the one regarding Nees as being false as well???

    I think that once Dateline does their show, it is going to show that Barry Beach is very close to obtaining freedom. The responsible parties in the Kim Nees murder are going to know this too. How many times have we seen this situation in our judicial system. The first one to come forward with information almost always gets a lighter sentence. Everyone else that follows gets the hammer. They are in a game of 5 card stud and about to get the fifth card. Do you fold and keep something to play with later, or keep betting on luck and lose everything.     Perhaps this topic will force the state of Montana to examine the justice system. Justice in the rural communities seeks to passify the victims and let fear rule the decision making process. A man can be sent to prison because their are limited resources in small communities to facilitate cognitive and behavioral changes. From my observation, Montana could benefit from examing their sentencing guidelines. It is my hope that bringing this topic to the national will inspire Montana to improve the system for which the taxpayers bear the brunt of supporting, not to mention the toll it takes on family members financially and emotionally.

Dateline chose to hold off on the revealing of this case for rating purposes only. The story is complete and they were ready to air it on Friday.     Anyway, so then someone get ahold of Kidd and guess what? He says he never said that. NEVER NEVER. But the courts (supreme one), as you say, won’t here this again, they say case closed. I think we need an uprising in this country. It started once, after the Ruby Ridge deal, and the Waco deal, then the Freeman deal (who the Gov.’s uncle was involved with).
    We probably need to wake up and smell the roses. They are not here to help us, it is the government. I don’t trust them and I never will.

    Nearly 2000 years ago, a man was falsely convicted and made a sacrificial lamb for corrupt political beings. Today, we have an innocent man condemned to die in a prison cell by corrupt political beings. Isn’t it ironic that the dateline show should air on the same day, almost 2000 years later, as the day He was sent to the cross? Almost poetic.
