Colin Miller, a professor at the John Marshall Law School and editor of the Evidence Prof Blog http://lawprofessors.typepad.com/evidenceprof/, has done some research into the Barry Beach case and determined that the transcript of Beach’s alleged confession to Louisiana authorities possibly should have been excluded at his trial and might be excluded should he be granted a new trial. Miller argues that there is a reasonable argument that the tapes of Beach’s confession were lost in bad faith, precluding the introduction of the transcript into evidence.
