The New Justice For All

We have had ups and downs in this blog and Montanans For Justice feels that now would be a good time to make a clean start. With over 1000 comments between 6 posts, there has been plenty of attention. Maybe it would help to have only one post…? Let’s try this for awhile. If you would like to comment from another post, please refrence that post when you comment here. Let us together find justice for Barry Beach and for all Montanans.

    When is Montana stop prolonging the truth? It’s been 27
    years too long! Ms. Kim Nees is just as deserving as Barry
    for justice!!

    A few of the FACTS that are documented and undeniable most
    of which are found on this site.

    From the beginning Montana had help railroading Barry.
    While in Louisiana custody 3 1/2 years AFTER Ms. Nees
    murder Barry was coerced into signing 3 different
    confessions for 3 different murders!

    Before the Board of Pardon’s and Parole hearing, Mike
    McGrath the then Attorney General of Montana’s own
    investigation before the farce of a hearing received
    statements, which his own reports state how 4 different
    people are known to have had the same necklace that
    belonged to Ms. Nees. Autopsy reported a piece of broken
    chain was found on her person.

    #1 MAUDE GREY HAWK KIRN Also, known to be involved in
    3 murders to include her own husbands, Dana Kirn
    BOARD OF PARDON’S AND PAROLE SWORN TESTIMONY SISSY ADKINSON
    PAGE 155 – 156
    Maude called and told her that she had found Kim’s diamond
    necklace down by the river.

    #2 JOANNE JACKSON TODD #3 EDDIE VANDOVER
    JOANNE JACKSON TODD’S STATEMENT TO MIKE McGRATH’S OFFICE:
    PAGE 12 Joanne, Eddie VanDover and she didn’t know who they
    were with saw a necklace “A gold necklace with a diamond”
    by the river. Ed VanDover took it from her. PAGE 14 “It was
    a gold with a little diamond in it. A little cross with a
    diamond in it.”

    #4 CALIB GOURNEAU, imprisoned for drugs and is now on the
    meth task force for the Fort Peck reservation? He found the
    same necklace as the others on 2 different occasions!
    GOURNEAU admits to having a broken necklace and stated to
    Mike McGrath’s office he turned the necklace into Stevie
    Grey Hawk. Then in the SAME STATEMENT TO MIKE McGRATH’S
    OFFICE he states he found the same necklace again in the
    fall while walking his dog!

    MIKE McGRATH SHOULD BE HELD ACCOUNTABLE FOR THIS AS I
    DIDN’T HEAR IT BROUGHT TO THE ATTENTION OF THE BOPP OR TO
    BARRY’S ATTORNEY’S DURING THE HEARING!

    Document stating FBI’S COMMENT 1979, TWO CIVILIANS TURNED
    IN PIECES OF JEWELRY THAT HAD BEEN FOUND WHERE POLICE HAD
    ALREADY THOROUGHLY SEARCHED.

    i didn;t even know about this case, one day sissy atkinson
    walked me back to a room and showed me kims class key that
    was in a jewerly box,(i didn’t know kim and i don’t know
    barry)-(this is probable 10-15 years after the murder) this
    was when i was a teenager. she threated me if i told anyone
    that she showed me the necklace. plus who would do anything
    about it in POPLAR mt.

    Barry Beach isn’t guilty! It’s proven time and time again
    both factually and forensically. The Montana authorities
    involved with this cover-up should be held accountable for their actions! The FBI should also be held accountable as there are natives involved with this
    murder! 10 UNIDENTIFIED PRINTS AND THE BLOODY PALM PRINT
    still have not been identified to this day! I’d put money
    on a bet IAFIS the FBI’s database holds the secret to
    opening those prison gates!

    This case should never have been closed until every one
    of those prints had been identified.

    Last but not least I didn’t find one single document
    showing Caleb Gorneau, Maude Grey Hawk Kirn, Joanne Jackson
    Todd, or Eddie VanDover’s prints, blood and hair were ever
    taken and compared to the evidence found! It’s a known
    fact Joanne Jackson Todd had clumps of hair missing from
    her head after Ms. Nees murder!

    Barry’s a political prisoner and it’s evident. Mike McGrath
    is now the Chief Justice of Montana’s Supreme Court.
    Barry’s been waiting for 15 months on a decision from the
    court. How much longer is it going to take for Barry to
    get justice in Montana?

    The evidence is clear, the murderers have talked!

    If Barry can be treated this way in Montana so can the
    rest of us! This needs to end NOW!

    I just watched Barry’s interview on KRTV.com and it was inspiring to say the least. Please go to their website and watch it! After viewing the interview please post your comments. We all know that this case needs as much attention as we can possibly give it. By posting your comments on their website it will bring more attention to Barry’s fight for freedom. The extended video is about 33 minutes long, so make sure you view the entire thing. Thank you so much to all of Barry’s supporters from all over the country and remember he needs us to fight for him. I truly believe that we are getting closer to seeing Barry as a free man!!!

    I recently watched the program on MSN about Barry’s case and I must say I was appalled by the failure of the justice system for this clearly innocent man. The failure occurred all the way from the judicial courts to the arresting officers. I just do not understand how the system, that we were raised to believe would protect us, could so completely convict a man without a shred of evidence, absolutely nothing!! What happened to “Innocent until PROVEN guilty??? If there was no physical evidence, no witnesses, nothing, how is his conviction justified? I am praying for justice for this man, who has lost so many years of his life and freedom. Stay strong, Barry, and remember that there are so many that believe in you and pray for your freedom. The courts need to prove that they are indeed fair and just in this “land of the free”.

    I too am beyond outraged over this case. I just became aware of it when I recently watched it on msnbc. I have written to every newspaper in MT. Every government official in MT. Even the president of the United States. As someone mentioned before I can’t help but feel all my efforts have fallen on deaf ears. Is there anything else that we as a group can do to help free this innocent man and correct this horrific wrong? I have spoken to Barry and made him a promise that I will never stop fighting for his freedom. The corruption surrounding this case is unbelievable. Can’t anyone see this, why hasn’t Barry been granted a new trial? None of this makes any sense to meI plead to all of Barry’s supporters to keep up the pressure, continue to write, continue to call and remember the squeaky wheel gets the grease.

    Barry Beach was 17 years old when Kim Nees was murdered. That qualifies him as a juvenile with unlimited potential. Why then would a judge sentence him to 100 years with no parole? Aren’t we supposed to rehabilitate our prisoners and allow them to rejoin our communities as responsible citizens? Is it acceptable to lock human beings up and throw away the key? I thought our legal and prison systems were more evolved. Why did the judge even include NO parole when Montana Statute 46-18-222 clearly states restrictions on parole eligibility Do Not Apply if:
    (1) the offender was less than 18 years of age at the time of the commission of the offense for which the offender is to be sentenced;
    Why did the judge not declare a mistrial when Marc Racicot knowingly mislead the jury regarding evidence from the crime scene, evidence he knew he could not and did not produce (see montanansforjustice.com)
    Please let everyone you know about this injustice and then come together as citizens of the United States in support of Barry Beach.
    Please contact Attorney General Steve Bullock and insist Barry Beach be given a new trial.

    I, too, took an interest in this case after seeing the original Dateline airing back in 2008 (I believe). I wrote to the Attorney General, Governor and Board of Pardons, but I can’t help but feel it landed upon deaf ears. I have a graduate degree in Forensic Science and in all of my studies, it absolutely amazes me that our judicial system has not granted a new trial for Barry. I don’t understand how the lack of evidence, the inaccuracies of Barry’s confession, the palm print that obviously pointed to someone, OTHER THAN BARRY, being present during the crime, and the gossiping of Maude, Sissy and the others hasn’t warranted someone in the criminal justice system to re-examine the case. There’s no way a jury would convict him in a new trial …there is far too much evidence out there to exonerate him. Anyway, just wanted to add my little 2 cents…I check back every now and then to see what new developments have occurred and each time I pray to see the headline “Barry Beach Exonerated and Freed from Prison”.

    I too was wondering the same thing as comment #162 – with regards to the Nees family and what they think.

    I have taken an interest in this case after watching the MSNBC program.

    I feel for Barry Beach. I too have been wrongfully done by the justice system here in KS. My issue has been cleared up and it paled in comparison to what Barry has gone through.

    Is there a way to write Barry in Jail?

    What are the other blogs I keep reading about that supposedly have the real attackers confessing?

    How does the Nees family feel about all this?

    What’s next in the legal system for Barry?

    I hope this gets cleared up and Barry is able to walk out of prison and gain some of the things he has lost.

    I watched the program concerning Barry Beach last night. A sad, but typical course of behavior these days taken by our legal system.
    I wonder, sice this appears to have been a possible kidnapping/homicide, why it hasn’t been the sole jurisdiction of the FBI all along? If the victim was lured or coerced to the area she was killed at, I mean.

    Attorney General Mike McGrath is running for Chief Justice of the Montana Supreme Court and thinks he will coast to victory on the basis of name recognition alone. He says he is for justice and the fair application of the law but his record in the Barry Beach, Jimmy Ray Bromgard, and other cases shows these are empty words. One of the best ways we can help Barry is by showing that elected officials who fail to uphold their oaths of office and pursue the truth will pay a price at the ballot box. An upset victory for Ron Waterman at least in part because of the Barry Beach case would get the attention of Montana’s political leaders real fast that the people are serious when they expect our elected officials to do the right thing. I encourage all who seek justice for Barry to vote for Ron Waterman. Tell all your friends and family to vote for Ron Waterman. Write a letter to the editor of Montana newspapers. We have an opportunity to send a powerful message that we will not tolerate this injustice.

    It’s really too bad, people don’t have the balls to admit when they have made a mistake. I wish the people/women responsible would have the guts to come forward. What if it was your son, brother or friend in prison for something he didn’t do. I still praying for you, Barry. I hope to God that this all comes to head and the people responsible are caught. Also, that the DA and AG are made to look fools and the cop who took the evidence goes to prison.

    CITY OF BILLINGS MAYOR RON TUSSING HAS HAD FOUR ETHICS VIOLATION COMPLAINTS FILED AGAINST HIM WITH THE BILLINGS BOARD OF ETHICS

    Billings Mt.,Aug 26, 2008–/MNA PRESS/–Billings Mayor Ron Tussing has had four ethics violations complaints filed against him, with the Billings Board of Ethics. A letter, signed by over 100 citizens, was sent to Judge Russell Fagg, in his capacity as Chair of the Billings Board of Ethics. The four complaints pertain to potential breaches of duty allegedly committed by Ron Tussing in his official capacity as mayor.

    According to Montana Code Annotated 2-2-121, public officers are prohibited from using public time, facilities, equipment, supplies, personnel, or funds to solicit support for, or opposition to, local ballot issues. The letter to Judge Fagg outlines four potential issues, in which Ron Tussing may be in violation of Montana State law. Ron Tussing, in his official capacity of mayor, is a member of the Celebrate Billings steering committee and as such, actively campaigned for and supported the passage of the 2006 Billings Ballpark Bond Issue and the 2007 School District 2 Mill Levy. Mayor Tussing also campaigned against the 2006 Repeal of the 2004 Public Safety Mill Levy.

    The complainants allege that Mayor Ron Tussing used Billings City time, facilities, equipment and supplies in support for, and opposition to, these ballot issues. The complainants attached over thirty (30) evidentiary exhibits, in support of their claims.

    The Billings Board of Ethics will meet to review the complaints. The complainants have requested that all members of the board, who have been appointed by Ron Tussing, be recused from the review process. The complainants also have requested that Victoria Cech, whose husband serves on the Celebrate Billings Steering Committee with Ron Tussing, be recused, as well.

    If the Board substantiates the complaints, the next step is to refer the complaints to the Yellowstone County Attorney’s office. The county attorney may then launch investigations into the alleged breaches of duty and fine Ron Tussing between $50 and $1,000, for each substantiated violation.

    Ron Tussing is running against Brad Molnar for Public Service Commission District 2.

    So the AGs office needs more time? Too busy? Heavy workload? Seems to me that August 8th snuck up on someone who was sleeping on the job…? Why did they wait until the day the brief was due to file for more time? The statements in the motion imply, at least to me, that they have not even worked on their response. Guess it isn’t important enough that an innocent man remains incarcerated. I’m sure the AG thinks that Barry has sufficient time to wait for him to get around to it. I’m sure Mike McGrath has had no problems getting around to working on his campaign for Supreme Court Chief Justice. Maybe if he spent part of his time seeking justice he might have been a somewhat decent candidate for the job, but remember, the rights of Montana citizens come second to McGrath’s political aspirations. Just the guy I want for Chief Justice. Yeah, right! (sarcasm intended)

    McGrath, Wellenstien, Plubell: Oh wait, let’s stop at Dairy Queen first and get some ice cream! Maybe Starbucks too! Barry Beach, who? Oh, he doesn’t mind waiting! We are FAR too important to rush in the name of justice. Who do you think we work for, the taxpayers?

    This taxpayer will be voting for Ron Waterman for Supreme Court Chief Justice. If you enjoy your civil rights, I encourage everyone else to do the same. (no sarcasm intended)

    I am so glad to hear what a success the Glasgow event was! We may also be thankful that an extension has been filed as this gives hope of actual investigation and not a hasty conclusion. We must all continue to rally support for Barry and let him know we are still fighting with him. Barry, take care of yourself and be safe! Things are going well on my end and I will be in touch soon.     Oh come on folks - Barry is NOT going to die in prison! He is the most amazing man I have ever met and I just refuse to believe that God would let Barry Beach die in prison. He is innocent! God knows this! EVERYONE knows this - including those no-good folks who are responsible for the horrible death of Kim Nees. So lets not let this get us down. Barry could have a heart attack and die tomorrow in prison - but he WILL die and innocent man. As long as he’s still very much alive - we have to continue to do our part to support and to fight for freedom. Dang it anyhow we can’t let the system beat us ALL! ****

    Barry may die in prison.
    In fact I have told him that more than once, since I got involved in this many years ago.
    But, I do know this…

    Barry will go to meet his maker, knowing that he did the best job he could,
    where he was at,
    to serve man, and mankind.
    He knows that God will smile upon him on that day.

    I know that God will smile upon me also on that day,
    for doing everything in my power to right this wrong.

    I have talked with many a soul who says to me, thanks,
    and I have met many a soul who thanks Barry for doing what he does to help mankind.
    He is truly an inspiration to all,
    including many guards I have talked with.

    I hope at the end of the day, or end of the road,
    God will smile on you,

    Hello. I enjoyed reading this blog. It’s nice to see all the speculation that is going on with this case. However, this blog will go down in history as just another part of this case. It is going to be sad when Barry dies in prison, because he will. The state made their decision and there is no way that Barry will every walk free. I am sorry to say that, but that is the facts. I am sorry that he confessed but now he will die of old age before he will every leave the bars of prison. I comment Montanans for Justice for putting in the effort to help Barry. I have resolved to believe that whether Barry is guilty or not, he will spend the rest of his life in prison and we that are still here will morn his lost. So continue with your work and good luck. The only place Maude will end up is in prison for drug dealing. She makes steady runs to the reservation every month. You would think the cops would have caught on to that by now, but we know how slow they are. Ed will probably die from Hib C and well that’s about it. So stay focused and keep on keeping on.

    Hello Fellow Bloggers…Barry is asking for all of us to support him in some way. I will continue to write letters and/or emails to spread awareness. I hope all of you will do the same..even if it’s just one!
    Barry deserves all the support he can get. Can you imagine having someone you love, such as a brother, son or even childhood friend, (who by the way is innocent,) spending their life in confinement? I can’t! Please help!!! Thank you~

    Montana has always had some serious issues with justice - look at history - vigilantees! Those of us who are convinced that Montanans need to hold those they elect accountable are starting to step up to the plate to confront injustices like that commited against Barry Beach. Maybe we are the ‘new’ vigilantees? Montana truly needs vigilant people to reorder more than a few things in this state!

    128 Well if Barry’s First Lawyer this Moses was dirty then Racicot probably had some dirt on him. If that was the case then maybe the original judge and others had the same thing going on. They all probably all knew each other. And its continued thru the years no one wants to come clean because of dirt somewhere else. Even the current AG and his bunch. After reading all the blogs and info on Racicot and other websites on corruption in Montana. The High Line seems a dirty place. Who could you trust? Not local law enforcment,DA’s. And some of the info seems to even point to corruption in the FBI back in 70’s and 80’s. Maybe they have cleaned house and the Fed’s can do something.

    i could only imagine the amount of attention this has brought to barry in prison. for the inmates who are his friends + know of his innocence - they have to be happy for him. for the others, they may try to make trouble for him + set him up. i find it very difficult to believe, that barry initiated any fight in prison. i do believe he was most likely provoked by a either a jealous inmate (of all the resent attention) or by one who was asked to do it, do to all the corruption that appears to be in montana. i hope it doesn’t get any worse. it sucks that this fight had him taking a step back. i’m assuming it was set up to make him look “violent”. so, so sad + how corrupt!!! when will it end.

    I would be interested in reading the court transcripts if they could be posted on this site.

    It comes as no surprise to me that another innocent person was convicted of a crime they didn’t commit. Montana courts are nutorious for convicting its citizens of crimes they dont commit, and even worse, taking the children away from perfectly good parents. This state is deplorable and its judges should all be jailed for their crimes.

    It would be nice to see the case posted on the site. Good luck, if he is truly innocent, then it is on us as people to prove it, and get him out of jail.

    Thank you for writing me regarding Barry Beach, an inmate at the Montana State Prison.

    As you may know, Mr. Beach presented an application for clemency to the Board of Pardons and Parole, which conducted a public hearing, took testimony and comments from the prosecutors, his defense team, and others, and considered extensive legal briefing. On August 26, 2007, in a 20-page opinion, the Board of Pardons and Parole denied Mr. Beach’s application.

    Pursuant to Montana statutes, as Governor, I may not grant clemency unless the Board of Pardons and Parole recommends to me that clemency be granted. Mont. Code Ann. § 46-23-301. I understand you feel strongly about this matter and I appreciate that you have taken the time to let me know your thoughts. However, because the Board of Pardons and Parole recommended that clemency be denied, as Governor, I am prohibited from taking a different course of action.

    #75 Barry isn’t a con. He is a victim in this case, just as much as Kim was a victim. Unfortunately we can not bring Kim back, but we most certainly can help Barry. Hasn’t anyone ever had you on the ground or had your arm pulled up behind you all the while saying “say Uncle…say Uncle…and I’ll let you go”??? finally you DO say “Uncle” and you are released. That is what happened to Barry.     I believe the key to this whole thing is getting someone in authority to at least admit that Barry could not have acted alone. I am not saying that Barry was involved, but the authorities seem to believe he is guilty. Anyhow, Barry could not have acted alone if the fingerprints and bloody palm-print do not belong to him nor Kim Nees. Therefore, there was someone else at the crime scene.     HEY, IF YOU CAN INSIST THAT IT BE TESTED, PLEASE DO SO. TO my knowledge Centurion or MFJ does not have the power to get the prints tested. The only one that can do that and access the fingerprint system (AFIS, or something like that its called) is a police officer and not all of them can even do this. A court order is another way to get it done. So how do we get it done? That is the question of the day. So Sad. I know of many people who have INSISTED till they were blue in the face.     As I have previously commented, I am a former MSP inmate. I know Barry. He may not be an angel, but he is as close as a locked up convict can get. There have been no “war stories” nor has there ever been a mention of a son. Hope this clears the air since there seems to be people who want to tarnish Barry’s name for no reason.

    #35, I know a former inmate from MSP who was a few cells down from Barry for a few years. He says Barry was a decent man that didn’t cause trouble and was active in various things throughout MSP while he was serving his sentence there. He absolutely believes Barry is innocent and most certainly wouldn’t say that if Barry proved him otherwise with ‘war stories.’

    #47 - wouldn’t that be something. She SHOULD seek legal advice and she SHOULD get herself cleared before those other two women team up and lay the entire blame on Maude.
    Sissy and Joanne are still in Poplar so it would make sense then that they team up against Maude. I’ve always believed that the first one to come forward is going to have the power as far as bargaining. One can only hope and pray that this is true! For not only Barry’s sake but also for Kim!

    First of all, what would a lie detector test do? Nothing. If you do not believe he is innocent by the overwhelming lack of evidence against him and the statements of many others, why would a lie detector test that can be faked or manipulated change your mind now?

    Second, I believe you are one of the original investigators in this case that is trying to keep your reputation untarnished. Here is why I think that: The ‘profile’ that was given for the murderer in the Louisiana cases was that he had homosexual tendencies. The Louisiana detectives treated Barry like a homosexual during the interrogations because of that profiling. Barry has always liked girls, has never had any other homosexual accusations brought against him, was not the murderer in the Louisiana cases, and is not homosexual. So, if you bring up something about Barry being a homosexual, then you are probably one of the idiots that thinks he is still guilty of the Louisiana murders, even though he has been cleared by DNA evidence and they have found the real murderer.

    Finally, get a life. The word is “Ciao”, which is Italian for “Goodbye”. But, I am sure you meant chow (like doggy-chow) because I know my dog is smarter than you are. Woof!

    Something to consider… Some folks are just now coming on board, either they never heard of this and have heard thru others that are making them aware, some may have just watched the Dateline show for the first time. Some may have just came across this website. So those of us who have been on this blog for a while now need to help these new folks get up to speed. We don’t need to be making remarks like “quit being so demanding, read first” - Just simply redirecting to the other link would work and sounds much better. After all….we are ALL trying to help Barry, so let’s stick together, not put a wedge between any of us. There are a LOT Of folks out there fighting for Barry. (very few like #35) Remember that! It’s ok to contact those other television folks, let them decide if they want to contact Dateline to do a follow up or not. We just need to bring the awareness to them, they’ll do the rest. Kim will follow them the rest of thier ever breathing days. Sissy’s remark about getting to Heaven and hoping those ministry guys will apologize to her for accussing her of this horrible crime - well guess what - NONE of them are going to Heaven. They should enjoy thier time here on Earth along with Marc Racicot, because when thier day comes, their going DOWN! There is not one single ounce of physical evidence that puts him at the murder scene. There is not one DNA test that showed he committed this murder and there is not one single witness. HOWEVER there ARE witnesses that saw those women kill Kim Nees. I’d say that’s worth a LOT more than a lie detector test. Anyone who reads the evidence, anyone who saw Dateline, anyone who KNOWS Barry, KNOWS he did not do this. So entertain us some more with your lack of knowledge.

    I googled TImer Moses to see what I could read about him. It would start with things like “well known criminal defense attorney” and “prominent Billings lawyer” “high profile”. IT seems to me that “they” got to him too. Ya know, the corruption? It seemed like he did nothing to defend Barry. His sister did offer this at the time, she wasn’t allowed to testify. He didn’t call the analysist Melnikoff or let Barry testify at his own trial. Doesn’t that seem odd? I mean this guy was discredited. He could have been here too if allowed to do so, so they could have used it against him. Maybe Moses was threatent too?

    #26 - funny that you mentioned this, because I have thought the same thing. The report said though that the nails were clean, however since the Forensic specialist was fired for misconduct, it is possible that more corruption lies in the lab as well. It could be possible that the there IS something under those nails! I think that the right folks could get a court order exhuming the body. However before doing something so drastic, it would be nice if ALL the folks who gave finger and palm prints were tested against the bloody palm print. I believe some gave samples, but there are those that did not, and those that have not been tested or compared. This might be a much easier routte first to eliminate that first. As a last effort I would agree and a court order might be obtained to exhuming the body. Your right if this was MY chld or sister - I would most certainly want to know who was responsbile for this. To simply put a man in prison and then THINK and believe that they have the right person, would not give me a peace of mind, if there was “resonable doubt” that it was done by someone elese. As is in this case - there is considerable amount of doubt !

    O.k., I was in Helena last week. I got to read a Helena newspaper and in it I read some disturbing news to me. I can’t remember the exact name, but it was free in the hotel I was staying in. It was on Tues. or Weds. that I read a small article about a murder in the 70’s. This 5 year old girl was sexually assaulted and murdered, but the killer was never found. They now want to find the murderer basing this on the ability to use d.n.a. I am assuming this is by exhuming the body? I know in my own heart that I would want to do this if this is my child. I also know that it seems extremely tacky, if you would, or a horrible thing for the Nees family, to even consider asking if this sort of thing would be possible. It was said somewhere that she fought back and tried hard to get away. I would think that under nails there might be d.n.a? Since in that article it mentions that d.n.a is extremely durable, not their words exactly, but what I can remember that it meant.

    I agree with #15 - the first jury is not responsible, they went with what was provided to them at that time. It is unfortunate however that Racicot being the snake he is was able to mislead the jurrors in to believing that Barry confessed in front of his attorney. When that was not the case. EVEN ifff the judge told them to disregard it, Racicot planted a seed that should have caused the whole thing to be dismissed. Centurion is and has been doing a great job, but one would think they could put more pressure on some of the folks in Poplar. They know a whole lot more than what is being said. Some of these folks do not live in Poplar anymore and the pressure should be put on them to talk. In todays technology there would be several ways to go about this. Any thoughts?

    Early in the investigation I found four jurors willing to talk to me. My interviews with them were non-confrontational, and I assured them that I would respect their privacy and anonymity. I wanted to find out from them what they heard, what stuck, and what influenced them. In my opinion, no purpose would be served by finding them and running new information by them. Unless one or more of them voluntarily come forward, I urge that they be left alone.
    Shortly before Barry’s hearing last summer, I came accross a fifth juror that I hadn’t found earlier. She wept at the possibility that she might have made a mistake. I explained to her that Barry Beach was run over by a train. The conductor was Mahlum and the engineer Racicot and the jurors were mere passengers.The original jurors are not responsible for Barrry’s predicament and should be left alone. Someday, perhaps, we’ll get a chance to go before another jury and we will be prepared.

    many of the jurors are still alive and Centurion has spoken to a couple of them.. What was the outcome? They belived barry was guilty back then based on the cops stating he admitted to his attorney and gave a confession to his attorney,, they also were very moved by the “role playing’ of the confession by jay via and mahlum..

    It’s only fair to mention that the other guy in the fight also got sent to the hole and also had a disciplinary hearing. Anytime there is a fight among inmates at MSP, if both are still standing, they both get punished no matter who started it. In prison, you may not start fights but if you don’t fight back you will be abused. Given Barry’s behavior over the last 25 years, there is no doubt in my mind that the other guy swung first. Barry had no choice but to swing back.

    Laura,yes Barry was in a fight last week. He had to have a hearing. He is more upset with himself than anything. He bumped in to the wrong person at the wrong time and that stuff happens. So a disciplinary hearing was held and he should be getting out of the “hole” today hopefully. He feels he let his supporters down more than anything. yes he most certainly needs our continued support. Keep writing letters to anyone you can think of! Write a letter to Barry as well.

    Any time there is any type of fight, rule violation of any kind, there is a “write up” given. The next step is to have a disiplinary hearing with a hearing officer at the prison, and they have a hearing with the inmate to determine what they feel the consequences are, there are points given when an inmate enters the prison depending on the crime.. and when they get a violation of any kind, points are given.. because Barry is in prison on Deliberate Homocide he has HIGH points anyway,., he had to earn his place on low side by having no write ups.. so when he had this hearing and fighting carries alot of points,,, then they send him back to the high side where he loses alot of what he had earned as far as priveledges, etc… The high side is higher security and less priviledges..

    Montanans For Justice has received confirmation from the Montana State Prison that Barry Beach has had his disciplinary hearing, was given a sentence of 10 days in the hole, will be out on May 3, 2008 (tomorrow) and will be placed on the high-side for a period of 3 years. All of this appears to be routine proceedure for MSP and we are sure that everyone (as we are) will be greatful to have Barry out of the hole tomorrow. MFJ
