Boxer: I would like you to go to MT.GOV. to realize why the judge handed down such a verdict. It had to be in writing as I researched, and how does that make you feel, what your thoughts have done to an innocent man? how does that make you feel?

i didn;t even know about this case, one day sissy atkinson walked me back to a room and showed me kims class key that was in a jewerly box,(i didn’t know kim and i don’t know barry)-(this is probable 10-15 years after the murder) this was when i was a teenager. she threated me if i told anyone that she showed me the necklace. plus who would do anything about it in POPLAR mt. Steve Grey Hawk was ON DUTY the evening of June 15, 1979 until the morning of June 16, 1979. According to TESTIMONY and verified by his being called to the scene when Maude hit Frank Marrotek’s truck.
12:38 a.m. June 16, 1979 Edna Grey Hawk (Steve’s wife and Maude’s Mother) was dispatching and called Steve Grey Hawk to INVESTIGATE “screams” coming from the Park Theory; Steve Grey Hawk went down to the Park – saw what the “GIRLS” and Maude, his daughter had done to Kim Nees. Steve Grey Hawk knew of all the evidence along with the sweater so he got rid of them in order for he and his daughter Maude not to be implicated in Kim Nees murder!!!! Being a police official he also knew about reverse psychology (most law enforcement officers do) so who better to cover-up for the “GIRLS” It might even be Steve Grey Hawk’s bloody palm print! When Police Officers remove a body from a vehicle they always close the doors and even lock them! Why else would the doors be closed and locked after Kim was dragged out. Since Steve Grey Hawk was a public official his fingerprints should be available.
I haven’t seen one single statement where Steve Grey Hawk has ever been interviewed by any agency! He’s never been held responsible for any of his actions in Kim Nees death and the cover-up!

A few FACTS that PROVE political corruption, and cover-up and the FACT Barry’s NOT BEEN ALLOWED THE OPPORTUNITY TO EXHONERATE HIMSELF! Marc Racicot’s 98% conviction rate all stemmed from Arnold Melinkoff’s testimony; being declared incompetent and NOT an expert in any field; Mike McGrath’s refusal to re-test all of Melinkoff cases. If tested and it’s discovered there’s been a gross miscarriage of justice? What would that make Marc Racicot’s track record look like? How about McGrath’s? Racicot bet his career on those convictions and by his board appointments? He’s still got his hands in Montana’s big 4 hasn’t he? Why haven’t the COURTS held the Montana State Crime Lab responsible for “supposedly” losing all of the evidence in Barry’s case? Why hasn’t Steve Grey Hawk ever been charged and convicted with tampering with evidence? He admitted to this crime. Why wasn’t Judge Sorte ever sanctioned for not calling a mistrial when Grey Hawk’s crime was discovered at trial? Why don’t the COURTS issue a court order for discovery to Barry? Why? The discovery will do just that PROVE Barry is innocent! The authorities are without a doubt guilty of coercion and corruption for their cover-up of the truth. Otherwise? They’d have found the owners of those 10 unidentified fingerprints, bloody palm print, hair, blood on the towel, foot prints, and investigated their very own statements relating to Kim’s necklace! They’ve all bent over backwards for 27 years to keep Barry in prison with not one shred of actual physical evidence against him not to mention the FBI cleared him in 1979. Barry’s brother had surgery on his appendix - just read the BOPP testimony.
Another point: DNA was conducted on cuttings from a bloody towel found near the scene of the crime,which resulted in findings that the blood stains did not come from either Barry Beach or Kim Nees. Results show that it matched to 0.09% of the native population. Wonder what “girls” that matched to???

Rose Failing Atkinson, Maude Grey Hawk Kirn, Sissy Atkinson, Joanne Jackson Todd, Roberta Jackson and Jordis Ferguson were in Steve Grey Hawk’s car that night. After Sissy bought beer at the Buck Horn Bar Maude hit Frank Marrotek’s pickup when she was backing out about 11:40 p.m.; side swiping Frank Marrotek’s truck. Sissy told Frank Marrotek that it was some big Indian guy that hit his pickup. Frank Marrotek called the cops and Steve Grey Hawk came to investigate writing the incident up as a hit and run. From that point Sissy was driving the Grey Hawk car. So how could the girls say they never saw Sissy again that night?
In-laws don’t always see eye to eye. I think Judy was doing the right thing in honor of Kim Nees and Barry Beach.

These are the DOCUMENTED FACTS about the murder of Kim Nees. Let’s stick to the FACTS and nothing else! This is a 30 year history of the confessions made by the “girls” to other individuals.
1979- June 16, 1979 – 5:00 a.m. 2 hours before Kim Nees body was ever discovered by anyone Sissy Atkinson called Dunn O’Connor and told him that Kim Nees body was in the Poplar River…..2 HOURS BEFORE ANYONE DISCOVERED HER BODY!!
1979- In Sept 1979 Mike Longtree admits to Orrie Burshia he says Sissy , Maude Grey Hawk Kirn, Joanne Jackson Todd, Jordis and Tara? Red Dog killed Kim Nees.
1979 – Tribal police officer Calvin First gives a statement that while gassing his car at about 2:30 a.m. on June 16, 1979 he saw the Grey Hawk car with Maude Grey Hawk Kirn, Sissy Atkinson, one of the Jackson girls and 2 others in the back seat coming out of the park.
1985 – Sissy Atkinson admits to Stubby Balbinot while working at A and S Industries; in the presence of Carl Four Star that she committed the perfect murder and Barry Beach is innocent
1988 – Joanne Jackson Todd Jackson while working at the Park View nursing home in Billings that she had visions of seeing blood all over the windows of a vehicle.
2000 - While at the Empire Bar in Billings Sissy Atkinson admitted to John Buffalo and 2 other individuals that Barry Beach was innocent and that she’s the one who committed the crime he’s serving time for.
1983 -2004 Over a 20 year period Maude Grey Hawk Kirn admits to Dana Kirn her husband; over numerous occasions throughout their marriage how she killed Kim Nees. Dana Kirn’s sister Maria Decker in 2007 says Dana admits to her he was going to the authorities with all of the information Maude Grey Hawk Kirn had confessed to him about her involvement in Kim Nees murders over the years. Dana Kirn was murdered by Maude Grey Hawk Kirn’s boyfriend Tracy McGowan the day before he was to give authorities his statement.
2008 - On the MFJ Blog Sissy Atkinson’s neice told of her being shown Kim’s class key and threatened her if she told anyone.
2005 – While living in Great Falls Sissy Atkinson admits to JD Atkinson her brother that she was there when Kim Nees was murdered and gave details.
2005 – While living in Great Falls Sissy Atkinson admits to Vonnie Brown that she was involved with the death of Kim Nees
2005 – While living in Great Falls Sissy Atkinson admits to Kevin and Tamra Hall, who just recently in 2009 gave statements with “specific details about the death of Kim Nees and that she and some other girls were involved.”
2007 – Maude Grey Hawk Kirn after being questioned by investigator Ron Kemp called Judy Grey Hawk her sister in law and admitted to kicking Kim Nees a couple of times in the head while she was lying on the ground.
2007 – While Tammy Pluebell and Mike Wellenstein of the Montana Attorney General’s office took statements from Sissy Atkinson, Maude Grey Hawk Kirn, Caleb Gourneau, and Joanne Jackson Todd all admitting to either having possession of or seeing the necklace of Kim Nees directly after her murder, which is a crucial piece of evidence and direct link to the crime scene.
2009 - Two individuals who wish to remain anonymous came forward to the KRT TV Kay Rossi and stated that Sissy Atkinson had confessed to killing a girl in Poplar to them.
Please add to these documented facts with information of your own so no stone goes unturned concerning the persons who murdered Kim Nees admitting their guilt over the last 30 years.

One more very important player in this is Maude’s father Steve Greyhawk, who “busted” into the clearly marked evidence room to go to the “bathroom.” Didn’t he live in Poplar and instead of breaking into a padlocked, well marked “KEEP OUT” evidence room to supposedly use the bathroom, why not go home! Did the Attorney General’s Office ever take a “sworn” statement from him? And, if not, WHY? Is he covering for Maude because she knows something or vice versa? The truth will come out at some point…
Maude: If you will look at the testimony of Judy Grayhawk to the BOPP, Vol II, Pages 556-559, Judy tells of a phone call you (Maude) placed to her in the Spring of 2004. You called to speak with her oldest son Steven aka “Mouse.” You wanted Steven to come pick you up because he had a car. You further told Judy that you wanted to get away from an Investigator who was investigating the Kim Nees murder. Judy said you sounded “despondent” or “lethargic.” Maude, you further told Judy, “All I did was kick her in the head a few times.” ” And I lured her down there…” Then, Ron Kemp also testifies before the BOPP, Pages 571-586…Mr. Kemp interviewed you in February 2004 where you told him that Sissy had discouraged you from coming to talk to him, that Mr. Kemp was just fishing. Mr. Kemp related that you told him that you and some other girls went down to the bridge and ran out of alcohol so went to the Buckhorn Bar, except for Sissy. In this interview Maude, Mr. Kemp stated you ecame upset and started crying stating that you had been using a lot of marijuana and wondered if he thought it was possible that you were there and, because of the marijuana and alcohol use, you had blacked out and couldn’t remember it. Maude, you also stated you believed that there was someone else involved. She thought that Kim was lured down to the bridge by another female because you couldn’t see Kim going down there by herself to meet with Mr. Beach; that Kim was kind of a scaredy cat. Maude, you further asked if you could be hypnotized? Mr. Kemp had written in his notes the names of the girls you said were with that night down there; namely,JoAnne Jackson, Jordis Ferguson, Sissy Atkinson and a Ramona.
Now, doesn’t it seem strange that if Maude is innocent in all of this that she would make statements putting herself right in the middle of it. Add to that the fact that she did not show up for the BOPP hearings because of “ridiculous accusations” even adds to making a reasonable person think she may be guilty, or at least involved…

Good work to all that, like I, believe in Mr. Beach. Note: on “Killing At Poplar”, a man on the video, is the one who took John Walshs’ son, Adam.

The “girls” certainly have some ’splaining to do. They will have plenty of opportunity to do so when the investigation is reopened upon Barry’s exoneration. First one in to turn state’s evidence gets the sweetest deal. Last one in gets the worst.

-Rose got home at 6:00 a.m. after sleeping a couple of hours at Sissy’s house?
The time sounds right! In interviews conducted by the AG’s Office with McKay, Plubell, Wellenstein and McDonald
-Sissy Atkinson - we were cruising around in Maude’s car with Maude Kirn, JoAnne Jackson and Roberta Jackson for about an hour. I bought them beer at the Buckhorn Bar at 11:00, and then Maude dropped me off at home.
-In yet another statement, Sissy says she walked home from the Buckhorn Bar
ROSE STATES SISSY ARRIVED HOME AROUND 6:00 A.M.
-Maude Grey Hawk Kirn - we were cruising around in my dad’s car, Sissy, JoAnne Jackson, and Roberta Jackson and myself. Stopped at the Buckhorn Bar between 11:00 and 12:00
-Maude said she ended up with Rose Failing Atkinson, Denver Atkinson, and John Prescott, and they headed North of Poplar, drank wine and got high!
-Maude said she arrived home around 4:00.
Nice try Rose and Maude, but John Prescott says IT DID NOT HAPPEN and your timing’s just perfect for being at Kim’s murder besides the fact witnesses have put you there.
-In another statement, Maude said she was cruising around and drinking in her car with Sissy Atkinson, JoAnne Jackson, Jordis Ferguson, and stopped at the Buckhorn Bar. Sissy left the bar and never said goodbye, and we never saw her again the rest of the night.
-When questioned by Ward McKay: Do you remember being down by the Park that borders the Poplar River between Highway 2 and the train bridge. Maude Kirn: I remember us turning around down, not in the area where Kim was supposedly killed, but you know there was a little…dirt road that crossed over to the other side of the river and there everybody used to flip u-turns right there. And, remember at one point that night we pulled over there to do a pee stop and everybody jumped out to go pee and that was as close as we came to that area, but we were on the other side of the River.
-Joanne Jackson Todd - told Marc Racicot that she got home before 12:30 and said she didn’t see Kim Nees at all. Joanne says that when she an Roberta were dropped off, Sissy was still in the car.
-Roberta Jackson - said she cruised around with Maude Grey hawk, Sissy Atkinson and Rose Failing in Maude’s car. Her younger sister JoAnne was also with them. She remembers parking at the Buckhorn Bar. Roberta says she and her sister Joanne had a curfew of 11:00
-In another statement, Roberta Jackson says that the same girls (Maude, Sissy, Rose) were inside the car when they dropped us off.
-Bobbie Ryan, owner of the Bum Steer, says she saw Sissy at the bar until closing time (2:00) along with Maude Grey hawk, Jordis Ferguson, Leslie and Berta,
JoAnne Jackson, and Rhea Red Dog. She said she had kicked them out 7 or 8 times. Also, Rose Failing WAS there and she booted her out.
-Ron Kemp stated he interviewed Maude Grey hawk Kirn who said everybody went to the Buckhorn Bar around 9:30 to 10:00, except for Sissy, and they never saw
Sissy the rest of the night.
So there we have it; in 2007 the Montana Attorney General’s office received conflicting information from the “GIRLS!” The question still remains why they continue to NOT investigate the reports they receive concerning Kim’s homicide! Barry Beach has been cleared by any wrong doing by the FBI; no witness has ever said Barry Beach was at Kim’s homicide, yet all the known “suspects” have given conflicting statements to the Attorney General’s office. I think that’s enough to pick these “girls” up and investigate this homicide!

Couldn’t have been a lone killer if you believe the confession. There would have had to have been a third person there because the bloody palm print conclusively does not match Barry Beach or Kim Nees. IF there was a lone killer, it wasn’t Beach.
A lone killer would have been afraid of being caught. He/She would have finished the job quickly. A group of girls on the other hand would have been able to shield the crime and take as long as they wanted. After all their intention wasn’t to kill her, they just wanted to rough her up and tell her to leave their boyfriends alone. They went too far and she died. Having family in law enforcement the girls weren’t afraid of the cops.

The assertion that Barry knew details about the murder that would only be known to the real killer is totally unfounded. The state cannot give specific details to support that claim. Law enforcement established 9 facts taht would have been known only to the killer. Barry got 8 out the 9 wrong plus many other important details. The confession was very clearly false and was obtained under highly suspect circumstances. Combine that with the fact that there is NO evidence or eyewitness testimony connecting Barry to the murder, the bloody palm print that belongs to a third person, and the long history of Sissy and Maude blabbing their mouths for several decades — and you come to the inescapable conclusion that Barry is most certainly innocent of this crime. Which can only mean that someone else is guilty.
Wambade: Obviously, you haven’t read the transcript of Dean Mahlum’s conversation with Jay Via detailing the crime scene evidence. Jay Via force fed the details to Barry. Anonymous, this is a good point! Isn’t there a Federal Law governing Sworn Statements, and wouldn’t the State of Montana have to abide by the law. If this was a valid confession the FACT is Barry would have made the corrections and initialed these corrections instead of Jay Via. So, wouldn’t this make the coerced confession invalid?
Looking at the statement given by Barry Beach to Jay Via, I do not see a SIGNATURE PAGE affirming that he gave his statement full and honestly starting with Page 1 and ending with Page 13, with all corrections on each page showing Barry’s initials, only Jay Via’s initials. Also on Page 14?, who is /kl - who typed this? Without a witness to Barry’s signature by another Officer or someone working in the office, the statement should be invalid.

Even though you’re entitled to your opinion, here are some facts to consider. Barry Beach will be going to Roosevelt County for an evidentiary hearing this year. At that hearing he will be presenting witnesses, and evidence beyond what was presented at the Clemency hearing. I was impressed with Centurion Ministries work and am more than anxious to see what kind of work they’ve done since. It is obvious what the true facts are. Like it or not Barry Beach and Kim Nees will be getting their day in court!

It was my understanding that the palm print, some fingerprints and a towel still existed. I am going to assume there is a description of the piece of metal from the pickup floor somewhere.
I would say the evidence that is missing from Steve Grayhawk breaking into the evidence room to go tothe bathroom is more than “highly suspect.” I know that the truth will “come out in the wash” someday, it always does!!!! I for one pray for the souls of the killers as only if they confess and tell the truth will they have salvation.
They did some DNA testing in this case a few years back; so therefore all of the evidence isn’t missing.

One of the FBI crime scene investigators stated the obvious: that the person who left the palm print on the door panel undoubtedly was responsible for the murder. Later analysis of the palm print determined that the print was not left by Kim Nees nor was it left by Barry Beach. Was that blood tested for DNA evidence? DNA in dried stains is remarkably resilient to degradation and can bedetected many, many, many years later.

Barry’s sister testified at the Board of Pardons and Parole hearing she saw Barry in bed at 12:30 a.m. with the same clothes he went swimming in and again at 6:30 a.m. before he went branding; his mom and grandma too saw him in the exact same clothes. I’ve heard the “state” has stated that the foot prints found may have belonged to the police investigating the crime scene. “A barefoot police force and female at that, ha ha.” Bob Murray, former Chief of Police of Poplar testified at trial the footprints IN the drag trail to the river were female.
Want to tell us all some FACTUAL information? Something that ACTUALLY happened? The confession that convicted Barry was COERCED and DOES NOT match the EVIDENCE! Thank God Montana now has a law in effect to prevent this from ever happening again to anyone else.
Hit from “behind” with blunt force? According to the AUTOPSY AND EVIDENCE Kim Nees WAS NOT hit from behind with blunt force; check the autopsy for that “fact” it’s NOT there. Lack of EVIDENCE? Just because YOU say it DOES NOT make it true. The FACT is this brutal, vicious, torturous attack on Kim Nees has not been vindicated. Former Roosevelt County Sheriff, Dean Mahlum stated under sworn testimonies at both trial in 1984 and again in 2007 at the Board of Pardons and Parole hearing; “There’s not a shred of physical evidence to match Barry Beach.” At least former Roosevelt County Sheriff Dean Mahlum’s testimony isn’t a state supported perjury.
The “girl” you refer to has a name and it’s Kimberly Ann Nees. She didn’t have to break it off with Barry because they never went together and really didn’t even like each other.
At every turn Montana has tried to stop this man from doing what should have been done 30 years ago. That speaks volumes. Kim will NEVER rest in peace for as long as her murderers walk free! Had Kim’s interest been at heart? It wouldn’t have taken 30 years and they still neither one have received justice. Sissy seems to have lied as her brother and other say she was present at the murder. I think the evidence could prove it if she is lying. I think the others who are willing to tell the truth should call the attorney and see what their options are. There might be some way they could agree to testify and tell the trueth and stay out of jail. I would think arrangements could be made to protect those willing to tell the trueth.

If I knew who killed Kim, I’d tell everyone and not worry who knew I told. I don’t know. I wasn’t at the party, if there was one. I wouldn’t have sat by while someone beat a person, not my style. I wasn’t even on the res at the time of the murder.
I was never afraid of that group of girls and I’m not afraid of them today. I don’t understand why, if there was a party, people aren’t telling what they know.
If hair and fingerprints samples still exsist, why doesn’t someone do some collecting on the suspects? Don’t the girls still go out in public? Can’t someone bump into them and take a couple hairs away? They touch items, can’t fingerprints be lifted? I know this might not be the legalist way to collect evidence, but once you know who did it, you could build a case and get legal evidence.
How is it her skull was crushed, but her nose wasn’t broke. Her jaw wasn’t broke. Her lip wasn’t split. Her teeth weren’t broke. I’m begining to think she may have been hit in the forehead as shown in the autopsy and then maybe she was face down. How can there be that many skull fractures and miss the jaw, nose, and teeth?
When one is getting kicked on the ground it would be common to find injuries to the ribs, stomach and other areas of the body. The autopsy shows no injury to these areas.
Kim must have been doing the hair pulling if you found something in the reports that shows the hair found in the middle of the seat was not Kim’s.
If the “girls” are innocent they should have demanded samples be taken from them to clear their names.
Considering the numerous statements given by Roberta Jackson, Joanne Jackson Todd, Jordis Ferguson, Rose Failing Atkinson and of coarse Sissy Atkinson (did I leave anyone out?); that they were all in Maude Grey Hawk Kirn’s car together; how is it they think everyone’s only thinking Sissy was the only one involved with Kim’s murder and not them? They have all admitted to being with her that night and Sissy’s verified this as well!

I believe the autopsy showed she was hit repeatedly over 30 times; short strokes and rapid; hard enough to pulverize her head. My opinion is she probably passed on within the first few blows as her skull was crushed! Certainly no time for nor any shape for Kim to spit chewing gum out much less get out and/or run around any pickup truck!

There are diagrams after the autopsy report, which clearly show this on the MFJ site. Girl’s would want to mess her face up just as girls like to pull hair in a fight. That’s not something a man would do.
As for the hair? There were clumps of hair in the gouge marks inside the pickup truck that was Kim’s, but the long brown hair inside the pickup truck found on the seat was not Kim nor Barry’s and it’s been proven was forcibly removed. If the police didn’t obtain any of the “girls” hair samples there would be nothing to compare to!

Hey Anonymous, Maybe it’ll make you feel safer knowing recently a man told me he knows Barry is innocent because he knows who killed Kim. He has already given his statement to Centurion Ministries and while he had thought about remaining anonymous he has since told me he would be willing to testify if it would help free Barry. So you are not alone! But we need everyone with info to step forward so we have all the pieces to this bizarre puzzle.

How does one get beat so badly about the head and still have chewing gum in their mouth? There is no mention in the autopsy of any teeth being broken.
The autopsy report dated 6-16-79 states no visible hair on clothing. A material summited 10/12/83 for analysis includes 2 hairs from victim’s shirt and 1 hair from victim’s pants. When were these hairs collected and by who?
The autopsy report makes no note of hair missing. If clumps of hair where found, who did the hair belong to?
If the victim was kicked as reported in some interviews, why doesn’t the autopsy show any injuries from the kicking?
I don’t believe the urine on the seat indicates death occured there. Reports show blood found outside the pickup on passenger side, some distance from the pickup. Was she removed from the pickup and the beating contiued in that area?
Why did it take four years before Ted Ness was interviewed about the tools? There is no evidence to prove there was a cresent wrench in the truck. If it was thought the victim was beat with some sort of tool, wouldn’t someone have been interested at the time of the murder as to what tools were in the truck.
A claw hammer was found 30 feet from the body in the river. Yet there is no mention in the interview with Ted Ness if he kept a hammer in the truck. Somewhere there should be an inventory list of items that were found in the truck and of items returned to Ted Ness, it would be interesting to get a look at that.

Kim had gone out with Steve Shagun till what 4 in the morning ONE NIGHT before she was murdered? Wasn’t that Susan Kirn’s boyfriend?

Anyone else defending themselves and not ending up dead would probably be sent to prison for life; those girls are the ones who seem to get away with everything witnesses and evidence or not! Seems to me they’d have done a better job of investigating Kim’s murder because she was actually killed. Like following their own evidence which is in the statements they gave and proved she was tortured and viciously murdered inside the pickup truck (urine on the drivers side, heavy blood stain on the passenger’s side where she was laying on the seat) instead of where the puddle of blood was found on the outside of the pickup truck. Fact is if that was the case the amounts of hair and blood splatter that was found inside the pickup would have been found all over the place around the big puddle of blood outside on the ground by the rear passenger side. Yes,I knew the group of girls as most of the people of Poplar did at the time. I didn’t know them or of them until the run-in with them. I wasn’t injured and never had any more problems with them. I didn’t fight the same fight that they were used to. I didn’t grow up on the reservation and was taught to fight first and ask why later when confronted with a surprise attack. At the time of the attack I thought they were trying to teach me the pecking order of the res as I was the new kid in town…..leave our boyfriends alone, keep your mouth shut, don’t mess with us–that sort of teenage thing. I think after the attack I was on the “don’t mess with her” list.
What would I have done different? I didn’t know their “tough act” had gone on for years and would continue into adulthood or that it would escalate to murder. Instead of taking the knife away from her and then leaving it where she could retreave it and walking past the group with the “you don’t want to f— with me” attitude; maybe I should have called the cops or hurt her with her knife or something to call attention to the thugs. What I can do is say…Yes people there was a group of girls and they weren’t nice. They did terrorize people. They weren’t any different than the Gangs you hear about in the cities today.

Well, I’ll agree with the way you think Kim was ambushed; except for the part where she was originally hit. There are matches to the unidentified bloody fingerprints found on the “inside” of the truck to the outside and on a beer can as well. That tells me that there was a party going on. I think Kim was originally struck outside the truck; remember that little boy hearing her cry for help and those on the hill who heard her too? Then after being struck she ran for the pickup, got in and then was struck through the window.
I too would like to know who’s prints were found on the inside door latch and the ignition switch. Some people say it could be Joanne Jackson Todd’s; she’s the one who had/has Kim’s keys or so I’ve heard not to mention she had big clumps of hair missing from her head after the murder! The long brown hair that was found in the pickup seat was not Kim or Barry’s. You know come to think of it? The FBI Latent Fingerprint Division only eliminated Barry, Greg Norgaard and Steve Shagun’s prints from the murder scene! WHO ELSE ???? Only 3 people out of an entire town were compared to the prints found at such a torturous murder scene? What in the world is going on???
Maybe whoever went after her from the driver’s side did lye down to cover Kim’s legs so that she couldn’t kick, then pulled the keys out of the ignition to assure Kim couldn’t escape! Gosh, that does make perfect since! Considering Kim’s head was pulverised on the left side; lying in that position being hit from the passenger’s side would account for the wounds appearing on the left side of her head, “backward wound marks”, those bloody fingerprints in the truck, the heavy blood stain on the passenger side of the seat, and the urine stain where I think she passed!! I wonder if the fingerprints by the tool box would match some of the bloody fingerprints inside the pickup? I’d say killing someone like that? Leverage isn’t the word for it.
I wonder at what point the necklace was jerked off Kim’s neck? According to the Attorney Generals statement several different people had possession of that necklace at one time or another.
From what I hear Celeste Shields was beaten to death just months after Kim’s murder. The same person who liked kicking Kim? Her personal items were stacked neatly just as Kim’s was found. Sure am glad someone else besides me sees the facts too!
As we all know; Caleb Gourneau and Shannon O’Brian wouldn’t have sat in Barry’s car for over 4 hours on a hot day with the windows rolled up and doors locked like Shannon said. Also, we know Caleb and Shannon DID NOT receive any ride from Barry Buckles and Greg Nolan, which has been verified.
In the Attorney General’s Taped Recorded interview with Caleb Gourneau; Caleb states on page 5 he and Shannon were BAREFOOT AND DIDN’T HAVE NO SHOES!!!
COULD CALEB HAVE LEFT THE INFAMOUS FOOT PRINTS FOUND AT THE MURDER SCENE OF KIM NEES? DOES ANYONE KNOW WHAT SHOE SIZE CALEB GOURNEAU IS?
I have also wondered if someone beat her and then left the scene. One of the interviews talk of the group of girls being across the river. Did they watch the first beating and then come to the scene and finish the job? This would give time for the blood on the drivers side. The second group may not have used the same weapon as the first person.
Why take the keys? Who would want them and why? Who’s prints were around the ignition?
It appears to me that the investigation ran away from the evidence. Even in the interviews, they would change the line of question if they got close to someone telling them something.
Almost everything in Barry’s confession was known on the streets of Poplar a year after the murder. Anyone put in Barry’s position would probably have given the same confession. If you were telling detectives what they wanted to hear you would have used what you heard on the streets.
The girls were known for surpise attacks. The first time I met them I had no idea I had any enemies (sp) in Poplar. One put a knife in my face and the others were waiting around the corner for their turns. They didn’t get their turns. If I’d have known then what I know now the whole incident would have ended different.
The way I put this together is Kim was sitting in the driver’s seat, window rolled down. One of the girls came up beside the pickup and hit her. Kim tried to defend herself and keep the door shut and the attacker was having problems with the door, steering wheel and such being in the way. The drivers door got opened. I would like to know who’s prints were found on the inside door latch. Then it appears the blows continued, maybe Kim was able to pull some hair. Is all the hair identified? I think at this point her head would have been about the middle of the seat. Ones feet make pretty good weapons sometimes and I wonder if Kim got turned around to kick the attacker. I believe she would have tried to move toward the passenger side using her feet to push the attacker back. The old pickups had a lot of space in them. The other girls would have been guarding the passenger door to block her esscape. I think the attacker was able to straddle her on the seat. To me the autopsy looks like she was lying down on the seat and the attacker was right handed. Most of the damage to the shoulders and arms appear to be on her right side. The passenger door must have been opened and the purse and sweater removed before the blows that happened on that side of the pickup or there would be mention of blood being on these items. The autopsy report doesn’t seem to include examination of the legs or feet. Her right shoe was ripped, on the right side. I’m thinking maybe she tried to use the door jam or steering wheel for leverage. The attacker couldn’t hit the left side because it would have been against the back of the seat. Maybe the girls on the passenger side helped get her in this possition. I wished I knew the possition of the palm prints from under the tool box on the passenger side. Where they made by someone standing in the door opening and using the side panel as a leverage point?
I think if all the blows had happened with her sitting in the drivers seat, there would be more damage to the left side of the body.
I still think there is a reason the necklace was ripped off. Norgaard gave her the necklace. Whoever removed it did it forcefully enough that part of the chain made it to the autopsy.
In the Etchemendy murder in Miles City it was thought the Indian women did most of the beating and they beat and tortured him for at least most of a day.
I’m not familiar with the Shields murder. When? Where?
That makes some since, but I don’t think there was enough room for anyone to be “sitting” on her. Remember there were gouge marks on the steering wheel and ceiling of the truck along with other evidence. It looks to me like from the police statements she was bludgeoned on the left side of her head and neck while sitting up behind the steering wheel, then fell over leaving the “heavy” amount of blood on the passenger’s side of the vehicle. I believe she passed her urine upon death as any pathologist would verify; it just took 45 minutes of them torturing Kim for her go.
Barry’s confession said he “hit” her on the left side of her head with the tool bar. Now if she was lying on her left side on the ground as he said in his coerced confession how in the world he could have hit her on the left side as the State of Montana claims? The evidence from the police officers clearly shows she was brutally bludgeoned inside the truck and not just a couple of times as in the coerced confession.
Everyone taking turns hitting Kim makes since as Judy Grey Hawk testified that Maude Grey Hawk Kirn told her she “only kicked Kim in the head a couple of times.” I couldn’t for the life of me understand why Maude would do such a thing, but now that you’ve said this is how these girls operate; makes perfect since. I’d say the person on the passenger side is the one who helped to remove her body from the seat and left that bloody palm print with a few of those bloody finger prints too; which would clear Barry if the State of Montana would them have compared in AFIS! Barry’s fingerprints were cleared by the FBI back in 1979; that says it all! Why hasn’t Montana run those prints??!!!!
As for the sweater and purse; just as in Celeste Shields (sp) murder; hers was folded neatly and the purse placed in the same manner as Kim’s, and her murder has never been solved! Look how many have been murdered over this! I believe we have Serial Murder(s) on the loose in Montana!

My thought on the urine being on the seat has been that I think the evidence shows Kim being pinned to the seat of the pickup, I think the person doing the beating was sitting on her, I also think the passenger door was open and someone was holding her shoulders down. If Kim was fighting for her life the strain of trying to throw these people off and the weight of the beater could have caused the urine on the seat. My thoughts on the hold down came from the autopsy report of the marks on the body.
The way that group of girls worked was everyone got a chance to give a kick or a punch; even if the victim was already knocked out. In this case knocked out or dead wouldn’t have mattered. When the body came out of the pickup—the others got their hits. Someone on the passenger side must have folded the sweater and sat the purse and sweater out of the pickup.
This statement is from Mike McGrath, while he was Attorney General. Funny; I thought the Crime Lab couldn’t “find” the evidence in Barry’s case!

I appreciate your response, but wasn’t specifically wanting to know about “soiling” more urination. I’m hopeful an expert can answer this question. I’ve known people who’ve passed on; urinated on themselves at time of death and would like this clarified professionally if possible. If a person does lose themselves at time of death wouldn’t the statements prove Kim passed on INSIDE that pickup? “urine on driver’s seat,” “gouge marks in the ceiling; gouge marks on the steering wheel” “Heavy blood stains on passenger’s seat.” Wouldn’t this say that she passed on then fell over onto the passenger side of the vehicle? Then if someone removed her body would it be possible to do this without getting blood on their hands? Wouldn’t they have left the bloody palm print on the side of the truck and “bloody smudged fingerprints on right upper molding”??
Barry’s confession states Kim Nees passed on “outside” of the pickup truck, but that’s not what the documents say. It clearly says all the blood splatter was found on the driver’s side of the vehicle; Barry’s confession says he “pulled her to him.” Has, any experts reviewed the information and concluded? Does anyone know?

I’m not a professional but if you are asking if bodily functions are lost at time of death, the answer is no. One does not soil themselves immediately upon death. I don’t know how long before it happens.
Is there any professional that can confirm one simple question, “Doesn’t a person upon death lose their bodily functions?”

People, don’t forget there was numerous murders on the Fort Peck Reservation close to the same time as Kim’s murder. How many of them are solved? how much effort was put out to catch the killers?

What is the State of Montana afraid of? and trying to cover up?
Find the answer and you find why Barry is in prison and why the Judge and the State are acting the way they are.
There are numerous unsolved murders in the State of Montana. They had to solve Kim’s. WHY?? I think they all should be solved but why was the effort put out to solve this case? And why Barry?? there were so many other more probable people they could have set up. The Nees family had pull on the State level at the time of the murder, the Atkinson and Grayhawk families had pull on the local level.
Was something going on within the State that had to be covered up in the news, so they made Barry the news?? I’m talking on the same order that the State of Montana found the killers for the Florence MT long unsolved murders to cover up the news that Barry was making progress toward getting out of prison.
I hope the Big Sky Cartel goes down when Barry walks out of prison as a free man. Only then can the good people of Montana feel safe.
Maybe its time for us to all write to Oprah and try to get national attention brought to Barry’s case. I know MSNBC did the story but Oprah reaches many more.
In the spirit of Pharaoh, the Montana judicial system has hardened their heart once again. District Judge Cybulski has recently refused to allow another judge to preside over Barry’s evidentiary hearing. To add salt to the wound in the same spirit of Pharaoh, Montana Attorney General Steve Bullock took it upon himself to file the necessary paperwork to oppose Centurian Ministry at the hearing.

When I saw Dateline “Barry Beach” I was shocked!!!!!!!!! I knew Barry when he was younger, I know that Barry would never ever commit such a horrific crime. With all of the people that came forward to testify on Barry’s behalf, I was in shock that the State of Montana did not overturn his conviction. I’m still in great shock. Barry has my total support and the rest of my family out here in Washington state. Hopefully, Barry will be exonerated with great support and see freedom once again. I was real glad to see the article. I am so glad the Great Falls Tribune isn’t afraid to report the news. I am in hopes that more people who know information about the murder will now come forward.
