A new trial...a new life

Barry Beach is currently serving a prison term of 100 years without the possibility of parole. Our judicial system demands a conviction beyond a reasonable doubt. Would you agree that there is reasonable doubt in this case? Is there any physical evidence pointing at Barry Beach? What if the coerced confession that was obtained from Barry in Louisiana is taken out of the picture? Could you convict Barry? The tragic event in 1979 has already ended one life. Could a new trial save the remaining portion of another innocent life?

1 - I believe the coerced confession should be thrown out of the picture totally. It has been proven, in Louisiana, that the other murders that Detective Via claimed Barry confessed to were done by someone else. (Comment this)

2 - It's hard to understand how anyone would confess to something they didn't do -- especially confessing to a murder one didn't commit. But look at all the false confessions that DNA testing has revealed. We can't imagine ourselves ever cracking under pressure like that but apparently it happens. (Comment this)

3 - On the website: www.montanansforjustice.com, there is the petition for a new trial in .pdf format. It talks about cases involving coerced confessions and studies that have been done. The enormous stress created in an interrogation, especially lengthy ones such as Barry Beach's, the person in question, even if innocent, will often give a confession just to end things. Trying to put myself in his shoes, I would think a reasonable thought process might be that if I confessed now and end this terrible interrogation, I could later prove my innocence and get out of prison. Although a reasonable thought process, it does not take into account that our system rarely ever admits it is wrong and would rather bury a potential problem than solve it. (Comment this)

4 - Barry was young and a long way from home. Although staying in Louisiana where his father lived; he had just upset his father and step-mother. His mother was in Montana. He probably felt very alone.
He had spent a few days in that jail. It appears the detectives were trying to hold him until he confessed to the Louisiana murders. Barry did confeess to the Louisiana murders, which he did not commit. Louisiana never charged him with the murders, but the confession took the heat off the detectives to find the murderer.
By getting the confession for the Kim Ness murder, they could send Barry back to Montana. By the time Montana figured out how the detectives got the confession, the Louisiana murders would no longer be front page news.
The problem is Montana just wanted a murder off it's books and someone had confessed.
I lived on the Fort Peck Reservation in the summer of 1981. There were 22 murders on the reservation that summer. To the best of my knowledge, no one ever went to prison for those murders.

Bobby Atkinson was acting chief of police..Sissy Atkinson is his sister, Rose (sissy failing) atkinson is married to his brother.
Maude Greyhawks dad was police officer, as was her brother...

10 - This may have started in Poplar, but Marc Racicot worked for the State of Montana at the time of the trial and went on to be elected Governor. The Pardons Board worked for the State of Montana and the current Governor is an employee of the State of Montana. Be carefull who you vote for. (Comment this)

11 - Barry confessed to 4 homicides when he was questioned in Louisiana and the justice system said Barry lied about 3 of the homicides and told the truth about 1 of them even though there was no evidence of him at the crime scene. (Of course he new more about the murder in his home town.) I wonder if a boy from Louisiana was picked up in Montana and confessed to the Nees murder and the Louisiana murders would the we thick that boy was guilty. I can see the Headline "Montana Detectives Solve Louisiana Murders" Wake up an smell the Evidence. The more I read about this confession the more things do not fit. Why would any one confess, maybe to go home to Montana and away from the men who would not take no for an answer, "Ok I'll say yes to everything if you just leave me alone" (Comment this)

14 - More murders in Poplar than any big city? Probably not. Although there are a lot unsolved murders. This is not because people are related to each other, but because Poplar, as many reservations are, is a ghetto without a city. Sad! High unemployment, alcoholism, etc.
Ghettos without a city. No where to go. Our government prefers to ignore the reservations, except for superficial assistance.

15 - Don't put it all on the government. There comes a point where a man or a woman has to stand up and say "I am not going to live like this!" Instead, I hear you say "Poor me!" The rez has the same problems as everyone else. We put our pants on the same way every morning...one leg at a time. When has the government stepped in to help me in my problems? NEVER! So, I get up every morning and do something about it. I make it the best day it can possibly be because that is what it takes. What, you want the government to give you more free money? It would just be spent on drugs and alcohol and you would be no better off. Quit complaining and do something for yourself. The Poplar people need to do something for themselves. 16 - It is so true. I know in my own life there has been plenty of times I did not want to believe the truth about myself but when I finally got enough Guts and Grace to face the bad part of my life I could do something to change it. I believe Barry is innocent and the truth must come out to free this Man. It's going to take Guts and Grace.
It's a hard thing to admit you are or could be wrong. I pray that we have a person who has first hand knowledge of this sad crime come forward and/ or there is person in authority who has the Guts to say I want the truth and work to get it. This case has not been easy and will never go away until the truth is known. I hope the AG's office knows this. From what I have read Montanasforjustice is interested in the truth, be it good or bad. 21 - i find it appauling that this man could have been convicted on non-existent evidence. it amazes me that a "confession" under such circumstances could be upheld with no physical evidence and so many people willing to implicate others in the defendant's stead. i watched the dateline nbc broadcast and could not believe they did not think this was a travesty of justice. good luck to you, barry beach, and god bless you. (Comment this)

23 - I think Barry landed in a snakepit when he met up with the "peace" officers on this case. It is obvious to anyone who has heard the evidence and listened to the testimonies that there are two tribes. There is the tribe that believes Barry is innocent and they have nothing to gain except truth and honor. But there is another tribe that refuses to acknowledge the evidence and probably because they they have a lot to lose. The irony of it all is that the rest of us can see that they are lost already. 24 - After watching Dateline last evening I could hardly sleep! I have never in my life been so convinced of innocence. It is obvious that the Justice system in that State needs a total and complete overhaul. Barry Beach is clearly an innocent man, and the truth must come out! There is not one single peice of solid evidence to keep him behind bars. We as a society should not stand for such an injustice as the question isn't if Barry Beach is guilty - it is what or whom is the justice system in Montana protecting? (Comment this)

Maude Greyhawk is rumored to live in Denver, hiding out. We could probably use her fingerprints and palmprints. Also Eddie Vandover may live their and along with his fingerprints, palmprints we could use his footprint. They have to be attained with a chain of custody though. (Comment this)

It may take months.

Mike McGrath is running for supreme court justice. He has been one of Barry's biggest problems and the cause of much injustice in this case if not the whole state.

I think McGrath and Rosciot are equally to blame.

Anyway Mikey is running for Supreme court, if he wins, what position does that put Barry in.

Mike will probably have Barry's case deadlocked for years and years and years if he wins. How sad is this.

I now the Competition, Ron Waterman is needing to raise funds as McGrath has a huge amount of money already.

32 - IDEA: Dateline set the stage for the American public to HEAR and SEE some of the case. But there are to many questions that the folks around the country wanting answers for . I think they should get 20/20 to do a follow up now. More coverage! More intense interviews. I’d like to see them interview the following:

Ask Steve Greyhawk just what he was up to and the same with Sissy’s brother

Ask Governor Schweitzer why he hasn’t stepped in and taken care of this matter and what he intends to do?

Ask Marc Racicot WHY he would mislead a jury the way he did?

Maybe even interview Clinton and Obama and ask them just what they intend to do if anything if they are elected? We know that McCain won’t do anything - for the love of God he’s a Republican and so was Marc Racicot and Marc was very close with Bush and so we know why Bush hasn’t’ stepped in.

Interview the FBI who apparently were involved?

We need more coverage on this case - more national coverage.

It’s an election year and would be a GREAT time to put some of the politicians in the “hot seat” and ask questions!

Nobody does it better than Barbara Walters or Diane Sawyer!

If they can keep the media going - and get more people to watch something like 20/20, it would spark more interest.

I think we should all write to 20/20 and ask for a follow up to the Dateline investigation!!!!

Their are good folks, your absolutely right, but I believe that those good folks are few and far between and those good folks are scared to death to be out after dark. Isn't that just a shame. I urge you to go to the Fort Peck Blog, check it out yourself. They are not happy people there! The good ones want justice served as well, they want Barry out too, so that THEY can leave in peace. Until then, the likes of the Greyhawk family, the Atikinsons will continue to threaten, beat, and murder anyone they so chose! They fight among themselves now. 12:00 – 1:30 p.m. – Sack Lunch (you bring) at Lockey Park. Take the Capital Street
Exit, when traveling west on Prospect Ave turn South (left) on Lamborn Street, travel 5 to 6 blocks you will run into Lockey Park. This park is close to the Capital Complex and is boarded by Broadway Street and Lockey Ave and Lamborn Street.
