Tip-Share Hotline

Montanans for Justice would like to thank all of the citizens of Montana and other areas for using our 'Tip-Share' tip line. This is exactly why we have it there: for those of you who could not for personal and protective reasons come forward in any other manner. We knew that there are some true Montanans out there with information about this case who would want justice for everyone involved. We want you to know that each and every tip we receive will be pursued and utilized to the fullest extent. Once again, thank you all for your support in this matter. We offer this forum as an opportunity for the people of Montana to show their support of the men and women courageous enough to share their factual knowledge about the death of Kim Nees.

6 - I watched Dateline tonight. I don't think there was ever enough evidence in which to keep this man in prison. He should never have been convicted by such circumstancial evidence. It amazes me, the ludicrousy of our court system. I completely believe that the so-called "confession" was coerced. (Comment this)

7 - It is completely obvious, that this entire "passionate conviction" is based upon small town politics. Maudes father (Police Man) kicks in a door to where evidence is keptthe night after the murder and this is just left alone....NO ONE in the entire police department thinks this is worthy of conversation....and then daughter does not show up to court.......As a criminal justice student, these are the cases I hear about that defer me from any type of law enforcement. It is not about justice. I will pray for you Barry! God bless your defense team.

8 - The only "incriminating" evidence is this confession which is easily shot full of holes. I mean come on, incorrect evidence word for word being repeated by the confessor (the brown plaid shirt)? And how can phyiscal evidence, such as bloody palm prints, not be "probative evidence"? I still can't get over the fact that the police father of a potential suspect broke into the evidence locker...what the hell?? This whole case smells of corruption. Former Govenor Marc Racicot is clearly trying to cover his ass and Montanna should be ashamed! (Comment this)

9 - Wow, I cannot believe what i just watched on Dateline tonight. The Montana Court System is screwed up! I find it puzzling that all those people from Poplar are giving testimony to the truth and it falls upon deaf ears. Will someone please listen and investigate the leads given by those who testified before the Parole Board. Maybe even the Parole Board needs to be investigated? Something smells funny in Montana.
I believe that Barry's confession was coerced. Hello, not the first time that has ever been done to an innocent person.
I believe the biggest problem for people in authority is to admit that they made an error. "Pride" is very ugly in a person and it takes humility to expose the truth. Those that are lying and doing the wrong thing...shame on you! "JUST DO THE RIGHT THING and CATCH THE REAL KILLERS"! (Comment this)

10 - My heart goes out to Barry Beach, his family and all the citizens of Poplar. I am stunned by what I saw on Dateline tonight. Someone should look into the Montana political and justice system because something smells very corrupt. From the past procecutor/two-time governor to the governor appointed parole board. And the police officer who broke down a door to the room holding the evidence that might've pointed a finger at his daughter....what the hell? NOTHING was ever done about that? I thought this stuff only happened in the movies. Shame, shame, shame! (Comment this)

But now I am embarrassed to even say I am from Montana. Boy, people must really think that Montana has no justice. Like I stated above I had never heard of this case until tonight and just what I have learned in this short of a time period I am convinced that Barry is innocent. This case is really showing how backwoods and reckneck the justice system in Montana really is. It make us look like fools. Makes you wonder how many innocent people in MSP are there. Come on people there is NO evidence against Barry other than some crooked Louisiana cops (and I know for a fact they are I have lived there also and seen the corruption) who made up a story to get some short lived fame. How the hell much reasonable doubt does there need to be??? This case is riddled with inconsistancies and poor police cover up and oh.... what about the missing confession tape that was probably pushed on to pause when Barry was fed what to say. I'd be looking into the Poplar police officers daughter more and what the ex boyfriend was causing in the American Legion Post after a few drinks and a group of persons did the crime. I believe the driver that says he followed the truck and thought he seen girls in the Ness truck, alot of men had long hair back then also. He was wrongly convicted and the courts should have thrown out the case. (Comment this)

17 - If the state of Montana were to release Beach from prison admitting to his innocence, they would be admitting to error within their justice system. Admitting to error within the justice system is questioning the prosecution's/governor's ethics, the investigation, police ethics and etc...
My question is why would the police officer break in to the Judges chambers to use the bathroom? He had to use the bathroom so bad?? Does it take more time to break a padlock than to go outside. Is he saying that he'd be in trouble more for urinating outside than breaking breaking an entry? Why couldn't his daughter show up to court - they could get an ex governor to court but not the policeman's daughter. The courts can place a man in prison for 2 decades but can't get this woman to show up in court? This case needs to go beyond the state of Montana. (Comment this)

22 - This is so true. I had never heard of this case before, and upon watching it on Dateline, I became very interested from the stand point that I am a recently retired Police Officer in California. From the moment the clues were preesnted on the show my forst thought was that this case is a huge mistake that now the authorities in Montana do not want to admit to.

In police work, the best way to porve a persons innocence is to attempt to prove them innocent. When a case is worked in reverse the real facts will come out and be obvious. In this case, the police wanted to close the case and no one really cared how it was done or that the facts never matched.

I understand the way interragations are done, and I understand the way some police work, I never believed in forcing the issues and clearing a case on the shoulders of the innocent, but some detectives do, and then some, as may be the case in Montana, the detectives just dont have the training of experiance to do otherwise. In any case, the facts will prevail, if the facts are not there then your looking in the wrong direction and it is time to back up, regroup and head in the new direction. In this case they did not want to that, they wanted a conviction to close the case and move on to less media attention cases, it was time to settle the natives in their minds.

I worked some of the largest financial cases in the state of CA, my expertise was picking out the inconsistencies in paperwork, stories, financial statements and interviews done by others, in this case the facts are a glaring red herring, let me help, I now have an drive to show the innocent in this case, lets show the facts and put it to rest, the facts are the truth and we cant change tem! (Comment this)

23 - I was questioned a few years back regarding someone involved, by the Centurion Ministries. I simply new of a suspect and where to find this person and I did that. I will tell you that with all my heart Barry Beach is innocent. The evidence alone say's that! The ass that actually influenced the parole board has "NO " right to make the comments he did and stand so closed minded to the facts and not free an innocent man because he has not the ability to stand up and,"say he is sorry but a terrible mistake has been made" 'YOUR RIGHT THE EVIDENCE JUST DOES NOT ADD UP". The confesion? clearly coerced! Crooked cops and crooked Governor! They are refusing to allow it to be proven! Why? We have a new Governor,One who will do what is right and get involved? Or so I pray! This is wrong and all for what? I believe the real killer/killers have gotten away with it, forever they will stick together! The State of Montana sat back and let it all happen. The foot prints alone not being processed should set him FREE!!!!!I am praying for you Barry! (Comment this)

24 - I can't believe it either. The Parold Board must be intimidated by Roscoe's power in Washington, DC. In one of the interviewes with Roscoe, near the end of the show, Date Line questioned him about the truck being full of people and he said none of their fingerprints were in the pickup. Well there were none of Barry's prints in there either!!!!!!!! And why was he given such a long sentence in the first place. Circumstantial evidence, evidence tampering and they never said it was premeditated or anything. And that special hearing at the end. What was that for? All those people asking that he be released and the Parole Board just ignored everyone. I hope everyone gets up in arms over this.

26 - Anybody have the answer to why the cop broke into the evidence room? Was he trying to dispose of evidence that might point to his daughter? What was his punishment? Did he give a reason why he did it? This case is so full of holes. Those in charge including the parole board must be idiots. Prosecuters never admit to being wrong even if they know they are wrong in their own hearts. They don't give press conferences when one of their convictions have been proved wrong by DNA. I watched the show and I was filled with rage. I believe those "girls" are the guilty ones. I wonder how some of these people sleep at night. I propose if you get it wrong at trial then you get to trade places with the wrongly convicted. Wonder how many would do everything they could to make sure they got it right the first time? (Comment this)

27 - Please never stop helping this man. I truly believe he is innocent and I am appalled by the callousness and blatent disregard for the facts and lack there of, of evidence. I am stunned that in this day and age, confessions alone, without ACTUAL physical evidence can put a man in jail for the inhumane 100 years. Those girls did this and Sissy Atchinson KNOWS something. As does that woman Maude. This was a 20 year old very young man who was scared. I think the sister of Nees can do more to help him. How do these people sleep at night? (Comment this)

28 - “I was amazed by the decision of the parole board that Barry Beach was guilty of murder. What I saw was a political ambush. We all know that people will confess to anything if enough pressure (or torture) is used. Even John McCain caved. Sadly, there was no video of the Louisiana interview with the "closer". The fact that other confessions taken by this officer were found to be false (surely gained by the same kind of pressure exerted on Barry Beach) should have held weight in the board's considerations. Of course, the retired "closer" would deny the abuse. He's living on a pension from the state.

The prosecutor, former Governor Racicot, said that he believed the confession held the same weight as physical evidence of Beach's guilt (though there was no physical evidence that he wasn't home in bed as his sister said). If the statements in the program are accurate, the board reiterated what the former Governor stated in the hearing. How would the public see the former prosecutor if the board voted against him? How many members of the board belong to the same political party as the prosecutor? How many owe their positions to this man and the political life of the state of Montana. How many plan their retirements from this service?

I believe your program proved that Barry Beach is innocent and was railroaded by the system into a false confession, and that he is forced to remain in prison because of the politics that outweigh the truth. Power and privilege have won again.”

29 - The answer regarding the Parole Board's decision was that the hearing was held with the decision already made. If you read the wording of the email (Again, how tacky is that?) the MT Board of Parole and Pardon communicated that "at last" this situation would be finally decided. Can we all hear that sigh of relief?

Hardly.

Not while ethical, honest people are still standing in Montana and beyond.

The power and influence of a prosecuting attorney turned governor appears to hold greater weight than truth and justice. That's what happens with power - it corrupts.

So do drugs and alcohol, which seems to go hand in hand with politics and law enforcement in Montana, particularly if you're a former governor, or the daughter of a tribal cop. Then I guess it's okay to kick another girl's brains out. After all, daddy will cover your ass, right Maude?

I've seen packs of wild dogs disguised as girls, and they are as violent and cruel as any male gang in L.A. or Oakland. Maude, Sissy and that gang are just a replication of spoiled trash with no self respect, self restraint or self discipline. They disgust me. That's why I had to learn to fight in high school. Because if I didn't, these bitch packs rule.

When I grew up I was told to trust and respect police officers. Now, after 23 years as an investigative reporter, I tell my 4 children to avoid law enforcement completely. Do NOT ask for help. It makes you a target. This may be difficult to hear for those honest law enforcement officers out there. So be it. I have a family to protect. In my view it is better for me to teach them to be smart and survive, than to open themselves to vulnerability to corrupt law enforcement, which serves itself and their kind rather than the people...particularly in Popular, Montana.

Keep the light on Centurians and Montanans for Justice. You're doing what's right.

Barry, keep the faith...

31 - Steve Gray Hawk, Maude Gray Hawk's father, was the office who broke into the evidence room. His claim was that he had to pee and that he believed there was a toilet in there. He broke the lock off the door and kicked in the door. His boss was the father of Sissy Adkinson, the woman on Dateline. Two corrupt cops plaing CYA. Then, Marc Racicot testified in front of the board of pardons and parole that it was his understanding that it was an honest mistake and that the door was not broken down at all. Read it for yourself in the transcripts available under Case Documents on the website. It is all a bunch of lies. I believe Marc Racicot should be prosecuted for perjury for this statement because he was under oath and the two tribal police officers should be considered as accessories to murder. (Comment this)

32 - I was in shock when I watched dateline yesterday. I've never even heard of the barry beach case but after watching dateline I knew for a fact that this poor man was innocent. I thought that people of the law were here to convict guilty people not to set up an innocent man, to scare him into giving a false statement. That was the only piece of evidence they had against this poor man. The funny thing is that there is so much evidence saying that he didn't do it and the court system didn't even care. It makes me wonder if they were paid off that would be the only reason they would find him guilty. Also I wonder if the cops got rid of eveidence from the crime scene that would explain why there wasn't any from the other girls that were there.

Beach did state that he was not there that night/morning- he said he had been earlier (5/6 p.m.) and his car broke down and he walked back to town half baked apparently then went to bed. This case is nothing but discrepancies and I for one am sickened that our former prosecutor turned governor isn't stepping up to the plate - c'mon the 'evidence' at the Montana crime lab came up missing!!!??? Not many people have that power ('cept maybe a gov. - now close ally to pres. Bush) Even if her were guilty the case should have been thrown out due to the obvious misconduct on Rascicot's behalf - in his opening statement he said that the (pubic) hair found on the sweater was i.d. as Beach's - NOT the lab said it was similar but no one was able to prove it was his - could have been hers for all we know.

Strangely quiet. A little too quiet as some would say. What? Nobody has anything to say or make remarks about after last nights Dateline? Some of you probably had flashbacks to when an interregator asked you questions. Not a pretty conversation. Mostly one sided and they will do and say anything to make you say something that is not true. An interregators main job is to make you forget those simple words. You have the right to remain silent. Instead they make you focus on: Your silence speaks volumes on your guilt. The justice system seems to be built on "guilty until proven innocent". Also, "once found guilty, the sentence is written in stone." One tends to forget that the ten commandents were also written on stone, they were broken and are broken everyday.

38 - I think we should thank Sissy Adkinson & Joanne Jackson for talking on Dateline. They both showed the NATION what liars they are and that they are hiding things. That's okay, when the investigators match the handprint and fingerprints, the UNSUB will be in jail and people are going to talk. Sissy and Joanne will go down too. And they will get just as bad of sentences for not coming forward with information. Even if they didn't actually do the killing, we all know they were there. Unless they start talking soon, they should spend the rest of their lives in prison. (Comment this)

The former governor should be ashamed of himself - too high in the political arena - he accused Barry of only remembering certain parts of things that happened to him and conveniently forgetting others - hmmm - wonder if a higher authority than the ex-gov asked him some things about his 'work' if he would be in the same position. And the sheriff - sad, sad, sad. And the parole board - what a closed minded group of people! Sorry, Barry, you deserve better than this. And then the fact that so many 'real' killers get out of prison with much shorter sentences! (Comment this)

45 - Barry, I feel sorry that you have to sit in prison. I hope that someday you will be able to get out. It is so scary to think that a killer is loose in Poplar. Someone whom we trust and talk to. I believe in your innocence and wish you the best of luck. I will be praying for you. God Bless...from Poplar. (Comment this)

47 - Some of us didn't know he was ever sent to prison. There wasn't any evidence, who would ever believe they would send him to prison?

Believe me, if I'd have known 25 years ago he went to prison, I'd have raised a ruckus. (Comment this)

48 - After seeing this story on Dateline i think all of us who raised hell as a kid and got into trouble..should step back and thank whoever was watching over us. I don't beleive because he was a "bad" kid it means he commited murder..it just means that this small town found a good victim to blame it on...young..scared..and fitting the profile. I was married to a detective in NY and know what these guys can do..especially to a scared young kid. It's not just small towns..it's everywhere.I believe Barry was so scared that he would have said anything to just get out of that place...i've heard that story too many times. There is a case in NY where a young boy ..17 years old..was found guilty of murdering his parents...no blood on him..no evidence except that confession that was taken after he was held for 22 hours. He spent 27 years in prison..and was just released..maybe awaiting a new trial...but they finally found there was just not enough evidence. I know there are thousands in prison screaming innocence...but only a few whispering the truth...Barry Beach is one of them. I only hope that one day he will be free and in peace with himself and the the world. If he reads this...Barry...my thoughts are with you and i wish you peace..love..and dignity. (Comment this)

49 - Do you know the details of that case? Name, case number, date? Anything. Maybe it could help Barry. (Comment this)

50 - Well if that's the case then I would think that Eddie V would do the right thing and go talk to the FBI (take it higher than your local police department - they are corupt enough) and maybe by giving a TRUE confession they would give lenancy to Eddie for bringing an end to all of this for Barry and put those girls away. For crying out loud I just read that Maude is in some pysch ward in Colorado? (laughing) This is the most amazing thing I have ever seen in my life. Come on Eddie V - IF you were down there - and it seems quite a few people have made comments that you were - then you just HAVE to do the right thing - plea bargain with them - give a confession with a lighter sentence - bring closure - be a hero! (Comment this)
